LTD &amp; 4 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMS\nAMRITA AJMERA for\nPetitioner(s) : 1, 1.2.1, 1.2.2, 1.2.3,1.2.4 - 5. \nMR NK MAJMUDAR\nfor Respondent(s) : 1, \nNone for Respondent(s) : 2 -\n5. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.K.RATHOD\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/03\/2009 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned advocate Ms. Amrita Ajmera on behalf of applicant, learned<br \/>\n\tadvocate Mr. NK Majmudar appearing for respondent insurance company.\n<\/p>\n<p>The<br \/>\n\tclaims Tribunal, Dhangadhra has passed an awarded dated 10\/1\/2002<br \/>\n\tand granted Rs. 4,45,000\/- with 9% interest in favour of respondent<br \/>\n\tclaimants.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Ms. Ajmera submitted that total amount of Rs. 7,16,594\/- is<br \/>\n\tdeposited by insurance company before claims Tribunal and out of<br \/>\n\tthat, Rs. 60,000\/- is directed to withdraw by claimants in respect<br \/>\n\tto share of Govindbhai Panabhai, Kankuben Govindbhai and Ansuyaben<br \/>\n\tChaturbhai and interest is to be paid to three claimants quarterly<br \/>\n\twhich can be utilized for maintenance of family and education and<br \/>\n\twelfare of minors.\n<\/p>\n<p>She<br \/>\n\tsubmitted that this Court has passed an order in civil application<br \/>\n\tno. 4730\/2003 dated 17\/11\/2003, following order is passed by<br \/>\n\tDivision Bench of this Court, which is quoted as under:\n<\/p>\n<p>\t?SShri<br \/>\n\tKaria appearing for the claimants wants the  release of  the award<br \/>\n\tamount deposited by the appellants with the Claims Tribunal.  The<br \/>\n\tfamily of the claimants consists of       five members including two<br \/>\n\tminors.  Disbursement of total amount of compensation is not in the<br \/>\n\tinterest of family nor we  see any justification for doing so.<br \/>\n\tConsequently<\/p>\n<p>       we direct as under:\n<\/p>\n<p>An amount of Rs.60,000 (Rupees Sixty thousand) falling to the  share  of   Shri   Govindbhai   Panabhai, Kankuben Govindbhai and Ansuyaben Chaturbhai be released in their favour equally  after  proper  verification. Remaining amount be  invested  with any Nationalised Bank near the place of their residence by the Claims Tribunal  and  the Manager  of  the Bank will release the interest in favour of abovenamed three claimants quarterly  to  be utilised for  the   maintenance  of  the  family  and education and  welfare of the minors. The  Civil  Application  stands disposed of. Rule is made absolute.??\n<\/p>\n<p>In<br \/>\n\tview of aforesaid order passed by this Court, she submitted that<br \/>\n\tconfusion is that whether Rs. 60,000\/- is to be disbursed in favour<br \/>\n\tof three claimants individually or Rs. 60,000\/- is to be disbursed<br \/>\n\tonly three claimants.  Therefore, claims Tribunal has not properly<br \/>\n\tunderstood order passed by this Court as referred above and due to<br \/>\n\tthat confusion, amount is not paid to claimants by claims Tribunal.\n<\/p>\n<p>In<br \/>\n\tlight of this back ground, it is directed to claims Tribunal to pay<br \/>\n\tRs. 60,000\/- each between to Kankuben Govindbhai, Ansuyaben<br \/>\n\tChaturbhai by A\/c payee cheque in their name after proper<br \/>\n\tverification and rest of amount Rs. 60,000\/- for Govindbhai who<br \/>\n\texpired subsequently, claims Tribunal is directed to pay Rs.<br \/>\n\t20,000\/- to Dahyabhai Govindbhai, Rs. 20,000\/- to Hirabhai<br \/>\n\tGovindbhai and Rs. 20,000\/- Dayarambhai Govindbhai by A\/c payee<br \/>\n\tcheque in their name because this are legal heirs and representative<br \/>\n\tof Govindbhai Panabhai who died subsequently.  Kankuben is widow of<br \/>\n\tGovindbhai and this Court has already disbursed Rs. 60,000\/- in<br \/>\n\tfavour of her.\n<\/p>\n<p>Therefore,<br \/>\n\tit is made it clear that there may not be subsequently any confusion<br \/>\n\tto claims Tribunal.
