Hathi, learned advocate, appears for the appellant. None<br \/>\nappears for the respondents, though served.\n<\/p>\n<p>2.\t\tWe<br \/>\nhave heard the learned counsel for the appellant who reiterated the<br \/>\nsame contentions which were advanced before the learned Single Judge.<br \/>\nWe have gone through the judgements of the City Civil Court Judge,<br \/>\nAhmedabad and the judgement of the learned Single Judge. Both the<br \/>\nCourts have concurrently found on appreciation of oral and<br \/>\ndocumentary evidence on record that Jankiprasad (original defendant<br \/>\nNo. 1) had no authority to enter into a mortgage agreement with the<br \/>\npresent appellant, as he had no interest in the property whatever and<br \/>\ntherefore mortgage agreement must be held to be void and not binding<br \/>\non the plaintiff (respondent No. 1 herein). Further these findings<br \/>\nare based on the reported judgement of this Court and the Hon&#8217;ble<br \/>\nSupreme Court. We see no reason to take different view and we are in<br \/>\nagreement with the conclusions of the Courts below. We, therefore,<br \/>\ndismiss the Letters Patent Appeal.
