DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submits that the version of the<br \/>\n\tvictim recorded on 22.03.2011 reveals that she had love affairs with<br \/>\n\tthe applicant, travelled and stayed together with the applicant for<br \/>\n\tmany days.  It is further submitted that considering the medical<br \/>\n\treport, other attending circumstances etc., the  the<br \/>\n\tapplicant may be enlarged on bail by imposing suitable conditions.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, statement of the victim and other attending<br \/>\n\tcircumstances, without discussing the evidence in detail, at this<br \/>\n\tstage, I am inclined to enlarge the applicant on bail  in connection<br \/>\n\twith C.R.No.I-47\/2011 of Surendranagar Police Station  for the<br \/>\n\toffences punishable under sections 363, 366, 376 of the Indian Penal<br \/>\n\tCode, on furnishing   bond of Rs.10,000\/- (Rupees ten thousand only)<br \/>\n\twith one surety of the like amount to the satisfaction of the lower<br \/>\n\tCourt and on conditions that the applicant shall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m .\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
