    This petition is filed under Article 227 of the<\/p>\n
Constitution of India challenging Exts.P9 and P10<\/p>\n
orders passed by the Sub Court, Thiruvananthapuram<\/p>\n
in I.A.3304\/2004 and 4257\/2004.  O.S.492 of 2002 is<\/p>\n
a suit for specific performance of an agreement for<\/p>\n
sale.  That suit was decreed ex parte on 31.1.2004.<\/p>\n
Respondent   thereafter   filed   Ext.P5   petition<\/p>\n
(I.A.3304\/2004) on 31.7.2004 to set aside the ex<\/p>\n
parte decree under Rule 13 of Order IX of Code of<\/p>\n
Civil Procedure contending that respondent did not<\/p>\n
receive any summons and came to know about the<\/p>\n
decree  only  when   he  returned   back  home   on<\/p>\n
30.7.2004.  Ext.P8 (I.A.4257\/2004) was subsequently<\/p>\n
filed  on  29.9.2004   under  section   5  of   the<\/p>\n
Limitation Act to condone the delay in filing<\/p>\n
Ext.P5 application.  Petitioner filed objection to<\/p>\n
both the petitions.  Learned Sub Judge allowed the<\/p>\n
W.P.(C)1648\/2007             2<\/span><\/p>\n
applications under Exts.P9 and P10 orders.      Under<\/p>\n
Ext.P9 order the delay was condoned as follows:-<\/p>\n
           \"Heard.    I.A. Allowed on a\n\n           costs   of  Rs.500\/-.     For\n\n           payment of costs.    Call on\n\n           17.8.2006.\"\n\nOn   19.8.2006    I.A.3304\/2004  was allowed    under\n\nExt.P10 order and the ex parte order         was set\n\naside.      The order reads:-\n\n            \"Costs   remitted.      I.A.\n\n            Allowed.  Ex parte order set\n\n            aside as prayed for.    I.A.\n\n            Closed.\n\n<\/pre>\n
Learned counsel appearing for petitioner argued<\/p>\n
that     learned   Sub  Judge  did not  consider the<\/p>\n
objections filed by the petitioner to both the<\/p>\n
petitions       and     question  whether  there  is<\/p>\n
sufficient cause to condone the delay in filing<\/p>\n
the application or to set aside the ex parte<\/p>\n
decree was not considered at all.        It was also<\/p>\n
argued      that  I.A.3304\/2004 was  allowed on  the<\/p>\n

ground that cost was remitted without considering<\/p>\n
the question whether there was sufficient cause<\/p>\n
for the absence of the respondent when the suit<\/p>\n
was decreed ex parte.\n<\/p>\n
      2.Learned    counsel  appearing  for  respondent<\/p>\n
argued that respondent did not receive any summons<\/p>\n
and came to know about the proceedings only when<\/p>\n
he     returned    back  to   India  and   immediately<\/p>\n
petitions were filed and in such circumstance, the<\/p>\n
ex parte decree was set aside after condoning the<\/p>\n
delay.       Learned counsel appearing for petitioner<\/p>\n
submitted       that  Ext.P2  letter   sent   by   the<\/p>\n
respondent      to  his  sister-in-law  a   practising<\/p>\n
lawyer      which was produced before the Sub Court by<\/p>\n
the said sister-in-law        on 15.10.2003 establish<\/p>\n
that respondent was aware of the suit and in such<\/p>\n
circumstance learned Sub Judge was not justified<\/p>\n
in condoning the inordiante delay.<\/p>\n
      3. There is force in the submission made by<\/p>\n
learned counsel appearing for the          petitioner.<\/p>\n
When the ex parte decree is sought to be set aside<\/p>\n

contending       that   respondent\/defendant  did   not<\/p>\n
receive the summons and was not aware of the suit<\/p>\n
or the decree and petitioner plaintiff resisted<\/p>\n
the petition contending that respondent was aware<\/p>\n
of the suit and in fact authorised his sister-in-<\/p>\n
law to appear on his behalf and she appeared<\/p>\n
before      the   court,  learned  Sub  Judge  was  not<\/p>\n
justified in setting aside the ex parte decree<\/p>\n
without considering these facts.         Ext.P10 order<\/p>\n
shows that        learned Sub Judge did not consider<\/p>\n
either the sufficiency of the ground stated in the<\/p>\n
petition        or  the   objection   raised   by   the<\/p>\n
petitioner.       Instead petition was seen allowed as<\/p>\n
if cost was awarded earlier.       In that application<\/p>\n
no cost was awarded. Cost was awarded in the<\/p>\n
application       to condone the delay.    Even if the<\/p>\n
delay is condoned, court has to satisfy that there<\/p>\n
are sufficient grounds to set aside the ex parte<\/p>\n
decree.       There was not even an attempt to consider<\/p>\n
that question.       Ext.P10 order on the face of it is<\/p>\n
not sustainable.\n<\/p>\n

      4.        Similarly  Ext.P9  order   shows  that<\/p>\n
contention raised by the respondent to condone the<\/p>\n
delay or the objection raised by the        petitioner<\/p>\n
why     the     delay cannot  be  condoned,  were  not<\/p>\n
considered by learned Sub Judge.       Instead without<\/p>\n
considering any of the grounds, petition is seen<\/p>\n
allowed on terms. Ext.P9 order also bad in law.<\/p>\n
      5. Exts.P9 and      P10 orders are quashed.  Sub<\/p>\n
Judge,        Thiruvananthapuram   is    directed   to<\/p>\n
reconsider       I.A.4257\/2004 and  I.A.3304\/2004  and<\/p>\n
pass appropriate order in accordance with law.<\/p>\n
      Writ Petition is disposed of as above.<\/p>\n
