Heard learned counsel.\n\n\n\n2.             This misc. appeal is directed against the order dated\n\n22.11.1996 whereby the application under Order 9 Rule 13 C.P.C. for\n\nsetting aside the ex-parte decree dated 20.9.1996 was rejected by the\n\nlearned trial court.\n\n\n\n3.             The learned trial court has rejected the said application\n\non the ground that the summons of the Court were served on one\n\nRadha, claiming to be the wife of plaintiff Banshi Lal Teli and,\n\ntherefore, the service was treated as sufficient and complete and ex-\n\nparte proceedings were drawn against the defendant and the suit was\n\ndecreed ex-parte. The suit was for recovery of money.\n CMA-136\/1997-Banshi Lal Vs. Shri Mahendra Kumar.            Judgment dt.30.7.09\n\n                                         2\/3\n\n\n\n\n4.             The learned counsel for the appellant-defendant submits\n\nthat the name of wife of defendant Banshi Lal Teli was Narbada and\n\nnot Radha Sahu. His address was also 36, Ashwini Bazar, Udaipur\n\n(Raj.) and not Nehru Bazar, Udaipur and, therefore, the summons\n\nwrongly served on one Radha was treated as sufficient and trial court\n\nproceeded ex-parte.\n\n\n\n5.             This Court has also perused the endorsement of summon\n\nin question which shows the handwriting in endorsement \"\u092e\u0928 \u092e\u0930\n\n\u092a\u0924     \u0915     \u0928\u092e      \u0915     \u0938\u092e\u092e\u0928        \u092a\u092a      \u0915\u0915\u092f \" is different from the\n\nhandwriting of signature of Radha Sahu dated 30.9.1993. Therefore,\n\nprima facie it appears that the same Radha Sahu has not appended the\n\nsaid endorsement and this could be in the handwriting of the process\n\nserver or somebody else, who has given the report on 9.12.1993 that\n\nthe summons have been duly served on the wife of the defendant\n\nBanshi Lal Teli. Therefore, it appears that in view of the evidence on\n\nrecord filed along with the application under Order 9 Rule 13 C.P.C.\n\nincluding the copy of the ration card and LIC nomination etc. that the\n\nname of the wife of the defendant was Narbada and not Radha,\n CMA-136\/1997-Banshi Lal Vs. Shri Mahendra Kumar.            Judgment dt.30.7.09\n\n                                         3\/3\n\n\ntherefore, the learned trial court has proceeded on wrong assumption\n\nthat the summons have been duly served on wife of the defendant.\n\nConsequently, the learned trial court has committed an error in\n\nrejecting the application under Order 9 Rule 13 C.P.C. vide order\n\ndated 12.11.1996.\n\n\n\n6.             Accordingly, the present appeal is allowed and the\n\nimpugned order dated 22.11.1996 is set aside and the ex-parte\n\nproceedings against the defendant are also set aside. However, no\n\nfresh summons are required to be served on the said defendant. The\n\npresent appellant defendant before this Court would now appear\n\nbefore the learned trial court on 18th August, 2009. The learned\n\ncounsel for the appellant-defendant undertakes to inform about this\n\ndate and the learned trial court shall proceed in accordance with law\n\nafresh from the stage of service on the defendant for the said date 18th\n\nAugust, 2009 now.
