No.12054 of 2011\n                             Gama Poddar\n                                 Versus\n                           The State Of Bihar\n                                -----------\n<\/pre>\n<p>3\/   10th August 2011              Heard learned counsel for the petitioner<\/p>\n<p>                        and learned Additional Public Prosecutor for the<\/p>\n<p>                        State.\n<\/p>\n<p>                                   Supplementary affidavit filed has been<\/p>\n<p>                        taken on record.\n<\/p>\n<p>                                   The instant petition has been filed against<\/p>\n<p>                        an order dated 17.01.2011 passed by Additional<\/p>\n<p>                        Sessions Judge, FTC-1, Lakhisarai in Cr.Revision No.<\/p>\n<p>                        277 of 2010 refusing the prayer of the petitioner to<\/p>\n<p>                        release the vehicle bearing registration no. BR-08-G-<\/p>\n<p>                        4701 as well as order dated 2.11.2010 passed by<\/p>\n<p>                        Railway Judicial Magistrate, 1st Class, Kiul in RPF<\/p>\n<p>                        Jamalpur Work Shop Post Case No. 05 of 2010.<\/p>\n<p>                                   On 19.05.2010 the RPF personnel seized<\/p>\n<p>                        truck in question bearing registration no. BR-08-G-<\/p>\n<p>                        4701 loaded with property belonging to railway for<\/p>\n<p>                        which RPF Jamalpur Work Shop Post Case No. 05 of<\/p>\n<p>                        2010 was registered under Section 3(a) R.P.(UP) Act.<\/p>\n<p>                                   It has been submitted on behalf of the<\/p>\n<p>                        petitioner that he happens to be a bona fide owner of<\/p>\n<p>                        the vehicle bearing registration no. BR-O8-G-4701<\/p>\n<p>                        which he had purchased from Munna Sah. Further<br \/>\n<span class=\"hidden_text\">                2<\/span><\/p>\n<p>submitted that true it is that during pendency of the<\/p>\n<p>instant case, the owner book has been corrected in<\/p>\n<p>the light of transfer effected in his favour by Munna<\/p>\n<p>Sah before institution of this case but on account of<\/p>\n<p>anomaly created by RPF personnel, which has got no<\/p>\n<p>sanctity in the eye of law, the prayer has successively<\/p>\n<p>been rejected by the court below.\n<\/p>\n<p>           On the other hand, learned APP opposed<\/p>\n<p>the prayer and submitted that there happens to be<\/p>\n<p>provision prescribed under R.P.(UP) Act to confiscate<\/p>\n<p>the   conveyance    as   the   same     was        used   for<\/p>\n<p>transportation of railway property stealthily.<\/p>\n<p>           Gone through the successive order. From<\/p>\n<p>perusal of the same, it transpires that the grounds<\/p>\n<p>enumerated    therein    appear   to    be    in    conflict.<\/p>\n<p>Consequent thereupon, the same is set aside.<\/p>\n<p>Accordingly, the instant Cr. Misc. petition is allowed.<\/p>\n<p>The learned lower court is directed to release the<\/p>\n<p>truck bearing registration no.         BR-O8-G-4701 in<\/p>\n<p>favour of petitioner after duly verifying his claim of<\/p>\n<p>ownership and being satisfied thereupon on a bank<\/p>\n<p>guarantee of Rs.5 Lacs in connection with RPF<\/p>\n<p>Jamalpur Work Shop Post Case No. 05 of 2010.<\/p>\n<p>Petitioner will undertake that the truck bearing<\/p>\n<p>registration no.
