P. Meena, Public Information Officer &amp; Assistant Commissioner (North);\n<\/p>\n<p>        Complete information on query 1, 2 &amp; 3 was not given by the PIO claiming that this is voluminous<br \/>\ninformation. First information cannot be denied on the basis that it is voluminous. The PIO may under<br \/>\nSection 7(9) offer the information in another format,- such as by offering photocopies of all the relevant<br \/>\nrecords or inspection of the files,- but cannot refuse to give the information. The Respondent admits that<br \/>\nthis data is available on the computer and hence there can be no difficulty in taking the printout and<br \/>\nproviding the information. It appears that the then PIO Mr. Jagdish Chander and FSO (C-17) Mr. Sukram<br \/>\nPal refused to give the information without any reasonable cause.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      Mr. H. P. Meena, PIO is directed to provide the information on query 1, 2 &amp; 3 to the<br \/>\nAppellant before 30 January 2011.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the then<br \/>\nPIO Mr. Jagdish Chander and FSO (C-17) Mr. Sukram within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO &amp; deemed PIO are guilty of not<br \/>\nfurnishing information within the time specified under sub-section (1) of Section 7 by not replying within<br \/>\n30 days, as per the requirement of the RTI Act.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                              Page 2 of 3<\/span><\/p>\n<p> It appears that the PIO &amp; deemed PIO&#8217;s actions attract the penal provisions of Section 20 (1). A<br \/>\nshowcause notice is being issued to them, and they are directed give their reasons to the Commission to<br \/>\nshow cause why penalty should not be levied on them.\n<\/p>\n<p>The then PIO Mr. Jagdish Chander and FSO (C-17) Mr. Sukram will present themselves before the<br \/>\nCommission at the above address on 03 February 2011 at 03.0.PM alongwith their written submissions<br \/>\nshowing cause why penalty should not be imposed on them as mandated under Section 20 (1).
