All the petitioners opted for Post Retirement Benefits<br \/>\nScheme (Short as PRBS)1991 prior to the retirement. Under the said<br \/>\nscheme, the petitioners contributed their dues and were entitled to<br \/>\nAnnuity p.m. or quarter as opted by each of the petitioner.\n<\/p>\n<p>2.2  PRBS pension settled \/<br \/>\ndecided by the Trust 2\/3rd  of the pensionary benefits<br \/>\nwere  contributed to the PRBS and 1\/3rd  amount was<br \/>\ncommuted by each of the petitioner. This amount is fixed as per<br \/>\nprovisions of PRBS based on the pay actually drawn at the  time of<br \/>\nretirement.\n<\/p>\n<p>2.3 Gratuity payable to each<br \/>\nof the petitioner on retirement under Rule 5 of the ONGC Death,<br \/>\nRetirement and Terminal Gratuity Rules, 1995 was increased from Rs. 1<br \/>\nlakh to Rs. 2.5 lakhs.\n<\/p>\n<p>2.4\tThe PRBS 1991, was<br \/>\namended retrospectively with effect from 16.11.1995 and made<br \/>\napplicable to the claims of the petitioners which are already<br \/>\nsettled.\n<\/p>\n<p>2.5 \tRespondents ordered to<br \/>\nrecover the difference arising in payment of contribution to PRBS  by<br \/>\nthe petitioner duly amended PRBS with effect from 16.11.1995 from the<br \/>\nAdditional Gratuity Payable to the petitioners as shown in column 12<br \/>\nof the  Annexure  A  to the petition in case of each of the<br \/>\npetitioner. Consequently the petitioners were paid Additional<br \/>\nGratuity amount after deduction. Hence this petition.\n<\/p>\n<p>3.<br \/>\n\t\tHeard learned Advocates for the respective parties and perused the<br \/>\n\tdocuments on record.\n<\/p>\n<p>4.<br \/>\n\t\tLearned Advocate Mr. Mehta produced  on record the settlement<br \/>\n\tletter, which is accepted by the petitioner s advocate. Since the<br \/>\n\tfive petitioners out of nine have withdrawn the petition only four<br \/>\n\tpetitioners are left out. The grievance of the petitioners  is that<br \/>\n\ttheir additional Gratuity had been withheld by ONGC for a period of<br \/>\n\tabout four and half years from December 1998 to May 2003.
