Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :23\/02\/2007\n\n O R D E R\n              THOTTATHIL B.RADHAKRISHNAN, J\n\n                      -------------------------------------------\n\n                   W.P(C).Nos.749 &amp; 6094 OF 2007\n\n                     -------------------------------------------\n\n              Dated this the 23rd  day of February, 2007\n\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      It is not disputed that these writ petitions were preceded by<\/p>\n<p>at   least   8   or   9   writ   petitions,   which   are   mentioned   in   the<\/p>\n<p>statement   filed   on  behalf   of   the   first  respondent,   Welfare  Fund<\/p>\n<p>Inspector under the Toddy Workers Welfare Fund Act.  It is also<\/p>\n<p>not   disputed   that   amounts   are   due.     The   stand   taken   by   the<\/p>\n<p>petitioner   is   that   there   are   33     persons   who   involved   and<\/p>\n<p>proceeded   against   for   recovery   and   that   there   is   no   proper<\/p>\n<p>statement   of   accounts   issued   by   the   Welfare   Fund   Inspector.<\/p>\n<p>The petitioner has no complaint about the total amounts that is<\/p>\n<p>due to the fund.   If there is any amount which has been paid by<\/p>\n<p>any other person who would  be liable along with the petitioner,<\/p>\n<p>it is for the petitioner to point out to the Welfare Fund Inspector<\/p>\n<p>regarding   such   remittances,   who   will   give   credit   to   such<\/p>\n<p>payments.     This  need   not  deter   the  impugned  sale   proceedings<\/p>\n<p>which are now to recover nearly one crore rupees.     Therefore,<\/p>\n<p>WPC.Nos.749\/07<\/p>\n<p>&amp; 6094\/07<\/p>\n<p>                                   Page numbers<\/p>\n<p>while allowing the authorities to proceed with recovery action by<\/p>\n<p>conducting   the   impugned   sale,   if   the   petitioner   or   any   other<\/p>\n<p>person   involved   in   the   proceedings   furnishes   appropriate<\/p>\n<p>evidence to show that they have made any payments, that will be<\/p>\n<p>given   due   credit   while     the   said   accounts   are   finally   settled   in<\/p>\n<p>view of the recovery.\n<\/p>\n<\/p>\n<p>         The writ petition is disposed of with the above directions.<\/p>\n<p>                                  THOTTATHIL B.RADHAKRISHNAN<\/p>\n<p>                                                             Judge<\/p>\n<p>kkb.\n<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court N.
