Pujari, learned APP appears and waives service of notice of<br \/>\n\tRule on behalf of the respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>By<br \/>\n\tfiling instant application, the applicant &#8211; convict prisoner,<br \/>\n\twho, vide common judgment and order dated 19\/9\/2009 rendered in<br \/>\n\tSessions Case No. 78 of 2004 with Sessions Case Nos. 77\/2005 and<br \/>\n\t121\/2005 by the Ld. Addl. Sessions Judge, Rajkot, has been convicted<br \/>\n\tfor the offence punishable under Sections 302, etc. of the Indian<br \/>\n\tPenal Code and sentenced to imprisonment for life, has filed this<br \/>\n\tapplication, praying to enlarge him on temporary bail of 20 days to<br \/>\n\tenable him to attend  after-death ceremony of his father, who has<br \/>\n\tdied on 19\/9\/2010.\n<\/p>\n<p>We<br \/>\n\thave heard Mr. Prashant Mankad, Ld. Advocate for Mr. Chudasama, Ld.<br \/>\n\tAdvocate for the applicant, so also Mr. L.R. Pujari, Ld. APP for the<br \/>\n\trespondent State of Gujarat. We have also perused the averments made<br \/>\n\tin the application and also the supporting documents that form part<br \/>\n\tof the application. We have also  gone through the jail remark sheet<br \/>\n\tsubmitted by the learned APP during the course of his submissions.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remark sheet, we have noticed that the applicant<br \/>\n\thas undergone total period of 3 years, 1 month and 14 days&#8217;<br \/>\n\timprisonment.  During that period, he was enlarged on temporary bail<br \/>\n\ton one occasion on account of illness of his father and similarly he<br \/>\n\thas also enjoyed one furlough leave and on all the occasions  he has<br \/>\n\tsurrendered in time. He has not misused the liberty granted to him.<br \/>\n\tHis conduct in jail is good.   Besides this, a perusal of receipt<br \/>\n\tissued by the WQF Committee, Rajkot, it is seen that his father has<br \/>\n\tbeen buried in the said graveyard on 19\/9\/2010.\n<\/p>\n<p>In<br \/>\n\tview of this, we deem it expedient to consider the plea of the<br \/>\n\tapplicant to release him on temporary bail for a period of 15 days<br \/>\n\tfrom the date of his actual release.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application succeeds in part and is<br \/>\n\tpartly allowed.  The Applicant &#8211; Convict &#8211;  SALMINBHAI<br \/>\n\tSIRAJBHAI PATHAN \tis<br \/>\n\tordered to be released on temporary bail for a period of 15 days<br \/>\n\tfrom the date of his actual release on executing a personal bond of<br \/>\n\tRs.5,000\/- before the jail authority on usual terms and conditions.<br \/>\n\tThe applicant shall surrender to the jail authority on completion of<br \/>\n\t15 days from the date of his release without fail.  During the<br \/>\n\tperiod of temporary bail, the applicant shall not abuse the liberty<br \/>\n\tgranted to him and shall maintain law and order.
