In the year<br \/>\n\t1996, the Collector initiated proceedings and came to the conclusion<br \/>\n\tthat as the transactions took place between Adivasi and non-Adivasi,<br \/>\n\ttransactions were declared as nullity and passed orders quashing and<br \/>\n\tsetting aside the sale deeds. When they were challenged by way of<br \/>\n\trevision before the revenue authority,  orders passed by the<br \/>\n\tCollector were confirmed by the revenue authority. Hence, the<br \/>\n\tpresent petitions.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, Sidharth H.Dave for Mr.Ajay R.Mehta for the<br \/>\n\tpetitioners and learned AGP, Mr.L.R.Pujari for the respondent<br \/>\n\tNo.1-State in both the petitions.\n<\/p>\n<p>It<br \/>\n\ttranspires from the records that first transaction qua the disputed<br \/>\n\tlands in both the cases  took place in 1956  between one Fakruddin<br \/>\n\tMiyabhai Sheikh and non-Adivasi and houses were constructed on the<br \/>\n\tsaid lands. Thereafter, T.P.Scheme came into existence and new<br \/>\n\tnumbers were also allotted to the said properties as if they are<br \/>\n\tnon-agricultural lands situated in the City. Thereafter in the year<br \/>\n\t1985, the respective petitioners  have purchased the lands from the<br \/>\n\trespondent No.2-Rasilaben Samabhai Hathila. This clearly showed that<br \/>\n\tsince 1956 till 1996, no proceedings were initiated by the concerned<br \/>\n\tauthority and after long lapse of time initiated the proceedings.<br \/>\n\tReliance is placed on a decision of this Court reported in 1984(2)<br \/>\n\tG.L.R. page 1225 in the case<br \/>\n\tof Ranchhodbhai Lallubhai Patel Vs. State of Gujarat and<br \/>\n\tOthers wherein it has been held by this Court in para 4 as<br \/>\n\tunder:\n<\/p>\n<p>&#8220;On<br \/>\n\tthe peculiar facts of this case, it has got to be held that the<br \/>\n\tpower exercised by the concerned authorities under sec.9 was at<br \/>\n\tgrossly belated stage and as there was unreasonable delay in<br \/>\n\texercise of that power, the exercise would be ex-facie unreasonable<br \/>\n\tunjust and illegal.   &#8230;..   Such an action on the part of the<br \/>\n\tauthorities exercising powers under the Act for a number of years<br \/>\n\tand waking up one fine morning after 7 years by issuing  notice to<br \/>\n\tthe concerned parties for showing cause why the transaction entered<br \/>\n\tinto by them should not be declared as null and void, has got to be<br \/>\n\theld, on the facts of this case, to be quite unreasonable.&#8221;\n<\/p>\n<p>In<br \/>\n\tview of the law laid down by this Court in the aforesaid reported<br \/>\n\tdecision, order dated 30-10-1996 passed in LND-8 Case No.11\/96 by<br \/>\n\tthe Deputy Collector as well as order dated 28-3-2000 passed<br \/>\n\tSRD\/JMN\/PCHM\/22\/97 by the Deputy Secretary (Appeals), Revenue<br \/>\n\tDepartment, Ahmedabad, are quashed and set aside. Both the petitions<br \/>\n\tare allowed.
