      This petition is to condone the delay of 119 days in filing an<\/p>\n
M.A.C.Appeal. Heard. We take a lenient view. Petition allowed.<\/p>\n
Delay condoned.\n<\/p>\n
M.A.C.A.NO.929\/08<\/p>\n
      2.    Injured\/claimant is the appellant.           He had suffered<\/p>\n
injuries in a motor accident which took place on 27.9.2000. Upper<\/p>\n
end of right tibia suffered an injury. It was a displaced fracture.<\/p>\n
He was a mason by profession. He very reasonably claimed that<\/p>\n
his monthly income was Rs.1,500\/-. He was aged 42 years at the<\/p>\n
relevant time. He was an inpatient for a period of five days.<\/p>\n
Plaster of paris long leg cast was applied. It was removed only on<\/p>\n
30.11.2000. According to the appellant, there was limitation of<\/p>\n
flexion of the right knee consequent to the injury. He had to<\/p>\n
undergo physiotherapy for some period of time, even after active<\/p>\n
treatment.      He claimed a total amount of Rs.1.25 lakhs as<\/p>\n
compensation. The Tribunal on an anxious consideration of all the<\/p>\n
M.A.C.A.NO.929\/08            -2-<\/span><\/p>\n
relevant inputs proceeded to pass the impugned award directing<\/p>\n
payment of a total amount of Rs.22,273\/- as per the details shown<\/p>\n
below, which are available in paragraph 9 of the award.<\/p>\n

The compensation amount was directed to be paid along with<\/p>\n
interest at the rate of 7.5% p.a.<\/p>\n
      3.    We have heard both counsel. The learned counsel for<\/p>\n
the appellant submits that the appellant is aggrieved by the<\/p>\n
impugned award.        What is the grievance?         First of all it is<\/p>\n
contended that the compensation awarded under the head of pain<\/p>\n
and suffering is too low and inadequate.         Only an amount of<\/p>\n
Rs.10,000\/- has been awarded. Taking into account the period of<\/p>\n
hospitalisation, the fact that long leg POP cast was applied and<\/p>\n
was removed only after the elapse of a period exceeding two<\/p>\n

months from the date of the accident and considering the fact<\/p>\n
that there was limitation in flexion of the knee and consequent<\/p>\n
obligation to undergo physiotherapy, reasonable and higher<\/p>\n
amount must have been awarded as compensation, it is<\/p>\n
contended. Taking the totality of circumstances into account, we<\/p>\n
find merit in this contention.\n<\/p>\n
      4.    The learned counsel then contends that the appellant<\/p>\n
was a mason. The accident had taken place on 27.9.2000. The<\/p>\n
long POP cast was removed only on 30.11.2000. But the Tribunal<\/p>\n
had reckoned loss of earnings only for a period of two months.<\/p>\n
The nature of employment of the appellant – as a mason obliging<\/p>\n
him to physically exert himself standing, was not taken into<\/p>\n
reckoning by the Tribunal at all. The Tribunal was unrealistic in<\/p>\n
assuming that involuntary unemployment could have been only<\/p>\n
for a period of two months. We are persuaded to agree in the<\/p>\n
facts and circumstances of this case, considering the nature of the<\/p>\n
injury and treatment as also the nature of employment of the<\/p>\n
appellant, that there must have been involuntary unemployment<\/p>\n
for a period of four months.\n<\/p>\n
      5.    The learned counsel for the appellant finally contends<\/p>\n
that during the period of treatment until the physiotherapy was<\/p>\n

over, the appellant had been put to inconveniences and loss of<\/p>\n
amenities.     Quality of life which he was able to enjoy was<\/p>\n
impaired considerably even after completion of the immediate<\/p>\n
period of treatment. For this, only an amount of Rs.2,000\/-has<\/p>\n
been awarded. Further amounts are liable to be awarded under<\/p>\n
this head, even assuming that the appellant has not succeeded in<\/p>\n
proving permanent disability as a result of the accident and<\/p>\n
injury, it is contended. The learned counsel points out that the<\/p>\n
Doctor had certified that limitation in flexion of the knee had<\/p>\n
resulted and had advised to undergo physiotherapy.          We find<\/p>\n
force in this contention. We are satisfied that a higher amount<\/p>\n
must have been awarded under the head of loss of amenities.<\/p>\n
      6.    On the basis of the above discussions, we come to the<\/p>\n
conclusion that the appellant is entitled to the following further<\/p>\n
amounts in addition to the amount awarded by the Tribunal.<\/p>\n
\n\n  1.    Shock, pain and\n        suffering -            Rs.12,500\/- minus\n                               Rs.10,000\/-         = Rs.2,500\/-\n  2.    Loss of earnings\n        Rs.1,500x4           =Rs.6,000\/- minus\n                               Rs.3,000\/-          = Rs.3,000\/-\n  3.    Loss of amenities\n         and conveniences     Rs.5,000\/- minus\n                              RS.2,000\/-           = Rs.3,000\/-\n                                                   -------------------\n                       Total                       = Rs.8,500\/-\n                                                     =======\n\nM.A.C.A.NO.929\/08           -5-<\/span>\n\n\n\n      7.    In the result:\n\n         (a)     this appeal is allowed in part.\n\n         (b)     The appellant is found entitled to a\n\n<\/pre>\n
                 further amount of Rs.8,500\/- (Rupees<\/p>\n
                 Eight Thousand and Five Hundred only)<\/p>\n
                 in   addition   to  the   amount    already<\/p>\n
                 awarded by the Tribunal.\n<\/p>\n
         (c)     Needless to say the entire amount of<\/p>\n
                 compensation shall bear interest from the<\/p>\n
                 date of the petition to the date of payment<\/p>\n
                 at the rate of 7.5% p.a. as directed by the<\/p>\n
                 Tribunal.\n<\/p>\n
         (d)       All other directions of the Tribunal are<\/p>\n
                 upheld.\n<\/p>\n<\/p>\n
