Badusarai as per<br \/>\n        to the person before starting of revenue records<br \/>\n        Chakbandi along with names and<br \/>\n        addresses.\n<\/p>\n<p>3.      Date on which the chakbandi The consolidation process was started as per notification of<br \/>\n        process started and name of the Honorable L.G Delhi .The said consolidation work was<br \/>\n        officer on whose order the same was under process of sec 21(2) and the same was also under<br \/>\n        initiated along with copy of the same consideration in the court of F.C<br \/>\n        order.\n<\/p>\n<p>Grounds for the First Appeal:\n<\/p>\n<p>Unsatisfactory information provided by the PIO.\n<\/p>\n<p>Order of the First Appellate Authority (FAA):<br \/>\nThe FAA in its order suggested the Appellant to deposit the requisite fee to obtain the information with<br \/>\nrespect to query No 1.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                             Page 1 of 2<\/span><\/p>\n<p> Grounds for the Second Appeal:\n<\/p>\n<p>Unsatisfactory information provided by the PIO.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Absent;\n<\/p>\n<p>Respondent: Mr. Manoj Dahiya, Naib Tehsildar on behalf of Mr. Aashish Mohan, PIO &amp; SDM;\n<\/p>\n<p>        The PIO has informed the appellant in query-1 that he should apply on CA-I form as per DLR Act<br \/>\n1954. The RTI Act supersedes all prior act as per Section 22 of the RTI Act. When there are multiple<br \/>\nways by which information can be accessed by the citizens it is the citizen&#8217;s choice which route he wishes<br \/>\nto adopt. In the instant case the appellant had used the RTI Act and hence the PIO was duty bound to<br \/>\nprovide the information under the RTI Act. As per Section 7(3) (a) the PIO should have informed the<br \/>\nappellant the further fees representing the cost of providing the information together with the calculations<br \/>\nmade as per the Central Rules prescribed for the RTI Act. The PIO failed to do this and is warned that in<br \/>\nfuture such an action will invite the penalty provisions of the RTI Act.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      The PIO is directed to provide the information with respect to query-1 free of cost to<br \/>\nthe appellant before 05 October 2010.\n<\/p>\n<p>This decision is announced in open chamber.<br \/>\nNotice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                        Shailesh Gandhi<br \/>\n                                                                                              Information Commissioner<br \/>\n                                                                                                     24 September 2010<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
