The petitioner, a Police Inspector of the Police
\nDepartment of the State of Gujarat, has filed this
\nspecial civil application praying for issue of a writ of
\nmandamus directing the respondents to give him deemed
\ndate of promotion, and to pay him notional pay from
\n23-5-1974 on the post of Police       Inspector.      The
\npetitioner was given promotion to the post of Police
\nInspector under order dated 11th September, 1990 with
\neffect from 24th April, 1988. Learned counsel for the
\npetitioner contended that in the year 1974 juniors to the
\npetitioner were given promotion and, though there was no
\npositive adversity in his service record, he has been
\nsuperseded and as such he should have been          given
\npromotion from the deemed date of 23rd May, 1974.\n<\/p>\n
2.In this case arguments were heard by this Court
\non 9th April, 1997. During the course of arguments the
\ncourt has specifically put a question to the counsel for
\nthe petitioner whether the petitioner made any grievance
\nat any stage after his supersession in the year 1974 till
\nthe filing of special civil application. The counsel for
\nthe petitioner made reference to para 4 of the special
\ncivil application and contended that the grievance was
\nmade by the petitioner against his supersession in the
\npromotion made in the year 1974. After going through the
\ncontents of para 4 of the petition, the court was not
\nsatisfied that any representation was made by         the
\npetitioner.   Whatever averments made therein are vague
\nand incomplete. The counsel for the petitioner prayed
\nfor time to file copy of the representation made to the
\nDepartment. That prayer was accepted and the matter was
\nadjourned to 22nd April,1997. On 22nd April, 1997 also
\nthe counsel for the petitioner has shown her inability to
\nfile any such document. The fact remains that there is
\nnothing on record of the special civil application to
\nshow that the petitioner had made complaint about his
\nsupersession in the matter of promotion in the year 1974.
\nIt is the modus operandi of the employees of the Police
\nDepartment in the State not to make any grievance against
\nsupersession in promotion till they bagged promotion.
\nAfter bagging promotion they start claiming deemed date
\nof promotion, challenging the supersession.       Earlier
\nalso, in many cases this court has deprecated this
\npractice of the employees of the Police Department of the
\nState. Be that as it may.\n<\/p>\n
3.The petitioner has right of consideration for
\npromotion, and not right of promotion. The case of the
\npetitioner was considered for promotion in the year 1974,
\n but he could not stand to merits in comparison with his
\njuniors and as such his name was not included in the
\nselect list.    The respondents have come up with the case
\nthat the criterion for promotion to the post of Police
\nInspector was merit and not seniority cum merit. Though
\nthe counsel for the petitioner has contended that the
\ncriterion for promotion on the post of Police Inspector
\nat the relevant time was seniority cum merit, she has
\nfailed to produce any rule or regulation or circular or
\nanything in support of this contention.       Contrary to
\nthis,   the respondents made reference in the reply
\naffidavit to rule 53 of the Police Manual wherein it is
\ngiven out that promotion to the post of Police Inspector
\n(unarmed) has to be made on the basis of merits alone.
\nTherefore it is not the case where the case of the
\npetitioner    was    not    considered   for    promotion.
\nSupersession was made as the petitioner was not found to
\nbe meritorious.     Even if the petitioner has average
\nservice record, he may not be given promotion and juniors
\ncan be promoted in a case where criterion for promotion
\nis merit. Positive adversity is not a thing to be taken
\ncare of, if comparative merit has to be assessed, and
\nwhosoever    is    found   meritorious,  irrespective   of
\nseniority, he can be given promotion. Not only in 1974,
\nbut thereafter also, though departmental inquiry was
\npending against the petitioner, his case for promotion
\nwas considered in the year 1976 and in 1977.       But in
\nthose years also he was not found meritorious and his
\nname was not included in the select list. His name was
\nincluded in the select list for the first time in the
\nyear 1979 and a person immediately junior to him in the
\nsaid select list was promoted with effect from 22-4-1980
\nand accordingly he was given promotion from the said
\ndate.     If juniors were promoted on 11-10-1974 and
\n24-5-1976, the petitioner did not make any grievance
\nagainst those promotions. He has made grievance against
\nhis earlier supersession only after his promotion under
\norder   dated     11-9-1980, by approaching this court.
\nChallenge to the supersession made in the year 1974
\notherwise is not tenable and it suffers from unexplained
\ndelay and latches. This writ petition is filed by the
\npetitioner about four years after his promotion. Taking
\ninto consideration the totality of the facts of this
\ncase, I do not find any justification in the claim of the
\npetitioner for deemed date of promotion from 23rd May,
\n1974 on the post of Police Inspector.\n<\/p>\n
4.In the result this special civil application
\nfails and the same is dismissed. Rule discharged.      No
\norder as to costs.\n<\/p>\n
