JUSTICE DEO NARAYAN THANVI\n\n\nMr. Mahaveer Bishnoi, for the petitioner.\nMr. Sanjay Nahar, for the respondent.\n\n\n            Heard learned counsel for the parties and perused the\n\ncopies of record.\n\n            The learned first revisional court has rightly observed\n\nthat while taking cognizance under Section 190 Cr.P.C., the\n\nMagistrate has to see as to whether there are sufficient ground to\n\nproceed on the basis of the challan filed by the police. For the\n\npurpose of taking cognizance on a police report, the documents\n\nfiled under Section 173 Cr.P.C. are relevant in which both the eye\n\nwitnesses, namely Doonger Ram and Mukna Ram have clearly\n\nstated that Shiv Lal and Hema Devi were not present on the spot,\n\ntherefore there was no occasion to take cognizance against them.\n\nEven though, the learned Additional Sessions Judge has observed\n\nthat if evidence comes at the stage of trial, the Magistrate is\n                                  2\n\ncompetent to proceed on the application Under Section 319\n\nCr.P.C.\n\n            In view of this, the order of the learned revisional\n\ncourt requires no interference.
