Shiv Mangal Yadav vs The State Of Bihar on 20 July, 2010<\/div>\n
                     IN THE HIGH COURT OF JUDICATURE AT PATNA\n                            Cr.Misc. No.22595 of 2010\n                                SHIV MANGAL YADAV\n                                      Versus\n                                THE STATE OF BIHAR\n                                      ------\n<\/pre>\n
2\/      20.07.2010                Heard learned counsel for the petitioner, learned counsel<\/p>\n
                     for the State and Mr. Dharmendra Kumar, learned counsel for the<\/p>\n
                     informant.\n<\/p>\n
                                  Tower was to be installed at informant’s field, for which<\/p>\n
                     he paid Rs. 1,20,000\/- but neither tower was installed nor his money<\/p>\n
                     was returned. Submission of the learned counsel for the petitioner is<\/p>\n
                     that he has no concern with installation of the tower or with the<\/p>\n
                     Company. His presence is shown only as he prompted the informant<\/p>\n
                     to make the payment but in no way beneficiary.<\/p>\n
                                  Considering the facts and circumstances of the case,<\/p>\n
                     prayer of the petitioner is allowed.\n<\/p>\n
                                  In the event of arrest or surrender within one month<\/p>\n
                     from the date of receipt\/production of a copy of this order in<\/p>\n
                     connection with Brahampur P.S. Case No. 45 of 2010 above named<\/p>\n
                     petitioner shall be released on bail on furnishing bail bond of Rs.<\/p>\n
                     10,000\/- (ten thousand)with two sureties of the like amount each to<\/p>\n
                     the satisfaction of C.J.M., Buxar subject to the conditions as laid<\/p>\n
                     down under Section 438(2) of Cr. P.C.\n<\/p>\n<\/p>\n
