No.38320 of 2010\n                    NIRAJ KUMAR SON OF LATE DEEP NARAYAN SINGH\n                                           Versus\n                                 THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   10.11.2010              Heard learned Counsel for the petitioner and the<\/p>\n<p>                   State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                   offence u\/ss.386, 307\/34 of the Indian Penal Code and 27 of<\/p>\n<p>                   the Arms Act as well as \u00be of the Explosive Substance Act.<\/p>\n<p>                             Considering that the occurrence took place in the<\/p>\n<p>                   background of land dispute between the parties, who are<\/p>\n<p>                   agnates as also that no one was hurt in the transaction, let<\/p>\n<p>                   the petitioner above named, who is in custody since<\/p>\n<p>                   16.9.2010, be released on bail on furnishing bail bond of<\/p>\n<p>                   Rs.5,000\/- (Five thousand) with two sureties of the like<\/p>\n<p>                   amount each or any other surety to be fixed by the court<\/p>\n<p>                   concerned to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>                   Patna in Patliputra P.S. case No.126 of 2010, subject to the<\/p>\n<p>                   conditions (i) That one of the bailors shall be the<\/p>\n<p>                   mother\/sister of the petitioner and the other bailor will be a<\/p>\n<p>                   close relative of the petitioner who will give an affidavit<\/p>\n<p>                   giving genealogy as to how he is related with the petitioner.<\/p>\n<p>                   The bailor will undertake to furnish information to the Court<\/p>\n<p>                   about any change in address of the petitioner. (ii) That the<\/p>\n<p>                   bailor shall also state on affidavit that he will inform the court<\/p>\n<p>                   concerned if the petitioner is implicated in any other case of<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>            similar nature after his release in the present case and<\/p>\n<p>            thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on ground of misuse, (iii)<\/p>\n<p>            That the petitioner will give an undertaking that he will<\/p>\n<p>            receive the police papers on the given date and be present<\/p>\n<p>            on date fixed for charge and if he fails to do so on two given<\/p>\n<p>            dates and delays the trial in any manner, his bail will be<\/p>\n<p>            liable to be cancelled for reasons of misuse, (iv) That the<\/p>\n<p>            petitioner will be well represented on each date if he fails to<\/p>\n<p>            do so on two consecutive dates, his bail will be liable to be<\/p>\n<p>            cancelled.\n<\/p>\n<\/p>\n<pre>Narendra\/                         ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Niraj Kumar vs The State Of Bihar on 10 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
