SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/12\/2010 \n\n \n\nORAL ORDER<\/pre>\n<p>\tRULE.\n<\/p>\n<p>\tMr.LR Pujari,  learned Additional Public Prosecutor  waives service<br \/>\n\tof notice of rule for respondent &#8211; State.\n<\/p>\n<p>\tIn the<br \/>\n\tfacts and circumstances of the case and with the consent of the<br \/>\n\tlearned advocates appearing on behalf of the respective parties,<br \/>\n\tpresent application is taken up for final hearing today.\n<\/p>\n<p>\tThis<br \/>\n\tapplication has been preferred by the applicants  &#8211; original accused<br \/>\n\tNos.3 and 4, under Section 438 of the Code of Criminal Procedure in<br \/>\n\tconnection with First Information Report registered at CR No. I-104<br \/>\n\tof 2010 with Morva (Hadaf)  Police Station for the offences<br \/>\n\tpunishable under Sections 143, 147, 148, 149, 336 and 307 of the<br \/>\n\tIndian Penal Code and under sec.135 of Bombay Police Act.\n<\/p>\n<p>\tHeard<br \/>\n\tMr.U.M. Shastri, learned advocate appearing on behalf of the<br \/>\n\tapplicants and Mr.L.R. Pujari, learned Additional Public Prosecutor<br \/>\n\tappearing on behalf of the State.\n<\/p>\n<p>\tHaving<br \/>\n\theard the learned advocates appearing on behalf of the respective<br \/>\n\tparties and looking to the nature of the allegations of pelting<br \/>\n\tstones, made against the applicants and considering the fact that<br \/>\n\tthe applicants are  ladies  and other co-accused are already<br \/>\n\treleased on bail, present application deserves to be allowed.\n<\/p>\n<p>\tIn the<br \/>\n\tresult, this application is allowed by directing that in the event<br \/>\n\tof the applicants herein being arrested pursuant to FIR being CR No.<br \/>\n\tI-104 of 2010 registered with Morva (Hadaf)   Police Station,<br \/>\n\tthe applicants shall be released on bail on furnishing a bond of<br \/>\n\tRs.5,000\/-, each [Rupees five thousand only] with one surety of like<br \/>\n\tto  the satisfaction of the lower Court and subject to the<br \/>\n\tconditions that they  :-\n<\/p>\n<p>(a)\tshall<br \/>\ncooperate with the investigation and make available for whenever<br \/>\nrequired;\n<\/p>\n<p>(b)\tshall<br \/>\nremain present at the concerned Police Station on 22.12.2010 at 11.00<br \/>\na.m ;\n<\/p>\n<p>(c)\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them for disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>(d)\tat the<br \/>\ntime of execution of bond, furnish the address to the Investigating<br \/>\nOfficer and the Court concerned and shall not change the residence<br \/>\ntill the final disposal of the case till further orders;\n<\/p>\n<p>(e)\twill<br \/>\nnot leave India without the permission of the Court and, if are<br \/>\nholding passport, shall surrender the same before the Trial Court<br \/>\nwithin a week;\n<\/p>\n<p>(f)\tthis<br \/>\norder will be operative if the applicants are  arrested at any time<br \/>\nwithin a period of 90 days ;\n<\/p>\n<p>(g)\twithin<br \/>\na period of ten days from the date of arrest, the applicants shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>8.\tWith<br \/>\nthese directions, this application is disposed of. Rule is made<br \/>\nabsolute to the aforesaid extent.
