Shah, learned Additional Public Prosecutor waives service of<br \/>\n\tnotice of Rule on behalf of the Respondent-State of Gujarat.\n<\/p>\n<p>The<br \/>\n\tpresent application has been filed by the applicants-accused under<br \/>\n\tSection 439 of Criminal Procedure Code for regular bail after filing<br \/>\n\tof the chargesheet.\n<\/p>\n<p>The<br \/>\n\tapplicants-accused are charged with having committed offences<br \/>\n\tunder Sections 306, 498(A) and 114 of the Indian Penal Code, for<br \/>\n\twhich, FIR being I-C.R.No.55\/2010 has been lodged at Vanthali Police<br \/>\n\tStation.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Joshi for the applicants referred to the FIR as well as<br \/>\n\tthe impugned order and the papers including the dying declaration<br \/>\n\tproduced at Annexure-D and submitted that as stated in the dying<br \/>\n\tdeclaration recorded, it was an accidental case, however, it has not<br \/>\n\tbeen appreciated and considered. He, therefore, submitted that the<br \/>\n\tpresent application may be allowed as the investigation is over and<br \/>\n\tchargesheet has been filed.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Ms.Shah resisted the present application and submitted that<br \/>\n\tas stated in the FIR, the victim has stated in her dying declaration<br \/>\n\tbefore the brother as to what has transpired and the role attributed<br \/>\n\tto the applicant. She referred to the impugned order and submitted<br \/>\n\tthat FSL Report also suggests that it could not have been filled in<br \/>\n\twhen the stove was on. Therefore, considering the nature of offence,<br \/>\n\tthe present application may not be allowed.\n<\/p>\n<p>In<br \/>\n\tview of the rival submission, it is required to be considered<br \/>\n\twhether the present application can be entertained or not.\n<\/p>\n<p>It<br \/>\n\tis well accepted that this Court is not required to appreciate and<br \/>\n\tscrutinize the evidence in detail at this stage. However, for<br \/>\n\tconsidering the prima-facie case, relevant submission referring to<br \/>\n\twhether it was an accidental death or suicide can be considered on<br \/>\n\tthe basis of the evidence at the trial. Therefore, without further<br \/>\n\telaboration, considering the dying declaration and also considering<br \/>\n\tthe submissions made by the learned counsel with regard to oral<br \/>\n\tdying declaration, the Court is of the opinion that the present<br \/>\n\tapplication deserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicants are ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.55\/2010<br \/>\n\tregistered with Vanthali Police Station on their executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) each with one solvent surety<br \/>\n\tof the like amount to the satisfaction of the lower Court and<br \/>\n\tsubject to the conditions that they shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of their residence to the Investigating Officer and also<br \/>\nto the Court at the time of execution of the bond and shall not<br \/>\nchange their residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\ntheir passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\ntheir presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
