Justice ANTONY DOMINIC\n\n Dated :02\/09\/2008\n\n O R D E R\n                     ANTONY DOMINIC, J\n\n    -----------------------------------------------------------\n                    W.P.(C).No.26183\/2008\n    -----------------------------------------------------------\n          Dated this the 2nd day of September, 2008\n\n\n                           JUDGMENT\n<\/pre>\n<p>     The prayer sought for in this writ petition is for a<\/p>\n<p>direction to the second respondent to consider and pass<\/p>\n<p>orders on Exts.P2 and P3 applications. According to the<\/p>\n<p>petitioner, these applications are not considered because of<\/p>\n<p>Exts.P4 and P5, communications issued by respondents 3<\/p>\n<p>and 4, fixing the control line and building line. This court, in<\/p>\n<p>the    decision   reported      in   <a href=\"\/doc\/1752497\/\">Peer      Muhammed        V.<\/p>\n<p>Chirakandam Grama Panchayat<\/a> (2008(3) KLT 300) has<\/p>\n<p>already   held that, in the absence of a notification and<\/p>\n<p>publication under the Highway Protection Act, 1999, fixing<\/p>\n<p>of control line and building line, Exts.P4 and P5 cannot be<\/p>\n<p>enforced.
