No.898 of 2011\n                      SANJAY TIWARI, SON OF LATE GULAB TIWARY\n                                           Versus\n                                THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   23.03.2011              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                             The petitioner was refused bail by an order dated<\/p>\n<p>                  13.4.2010 but stating therein that it was being rejected for the<\/p>\n<p>                  present.\n<\/p>\n<p>                             Considering that the co-accused Pappu Mishra<\/p>\n<p>                  whose prayer for bail was also rejected by the same order has<\/p>\n<p>                  been granted bail by this Court by an order dated 21.12.2010<\/p>\n<p>                  passed in Cr. Misc. 41259 of 2010, let the petitioner above<\/p>\n<p>                  named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                  5,000\/- (Five thousand) with two sureties of the like amount<\/p>\n<p>                  each or any other surety to be fixed by the court concerned to<\/p>\n<p>                  the satisfaction of Sri Awadhesh Kumar, Judicial Magistrate 1st<\/p>\n<p>                  Class, Begusarai, in Barauni (Refinery) P.S. Case No. 224 of<\/p>\n<p>                  2009 subject to the following conditions: (i)That one of the<\/p>\n<p>                  bailors will be a close relative of the petitioner who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the<\/p>\n<p>                  petitioner and the other shall be the sister of the petitioner. The<\/p>\n<p>                  bailor will undertake to furnish information to the Court about<\/p>\n<p>                  any change in address of the petitioner. (ii)That the bailor shall<\/p>\n<p>                  also state on affidavit that he will inform the court concerned if<\/p>\n<p>                  the petitioner is implicated in any other case of similar nature<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        after his release in the present case and thereafter the court<\/p>\n<p>        below will be at liberty to initiate the proceeding for cancellation<\/p>\n<p>        of bail on the ground of misuse. (iii)That the petitioner will give<\/p>\n<p>        an undertaking that he will receive the police papers on the<\/p>\n<p>        given date and be present on date fixed for charge and if he<\/p>\n<p>        fails to do so on two given dates and delays the trial in any<\/p>\n<p>        manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>        misuse.
