RADHAKRISHNAN, J.\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n           W.P.(C).No.491 of 2009-H\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n    Dated this the 15th day of January, 2009.\n\n                   JUDGMENT\n<\/pre>\n<p>The petitioner challenges Ext.P6 notice issued<\/p>\n<p>calling for attendance and tendering evidence by<\/p>\n<p>way of documents, books of accounts etc. for an<\/p>\n<p>enquiry under the KVAT Act. That is issued in<\/p>\n<p>connection with an audit assessment stated to<\/p>\n<p>have been initiated on the strength of penalty<\/p>\n<p>proceedings, that led to Ext.P1 appeal before the<\/p>\n<p>competent authority. Against a conditional order<\/p>\n<p>imposed  while  granting    stay  pending   Ext.P1<\/p>\n<p>appeal,  the  petitioner  moved  this   Court and<\/p>\n<p>obtained the judgment in WP(C).20968\/2008. The<\/p>\n<p>Division Bench refused to interfere with that<\/p>\n<p>judgment and issued Ext.P4 enlarging the time to<\/p>\n<p>pay the amounts and granting an opportunity to<\/p>\n<p>the petitioner to file an application for early<\/p>\n<p>posting of Ext.P1 appeal after depositing the<\/p>\n<p>amounts covered by that judgment. Now, it is<\/p>\n<p><span class=\"hidden_text\">WP(C)491\/2009         -: 2 :-<\/span><\/p>\n<p> shown that petitioner had filed an application<\/p>\n<p> for early posting (Ext.P9) supported by Ext.P10<\/p>\n<p> remittance.   It is   submitted   by  the  learned<\/p>\n<p> Government Pleader that Ext.P1 appeal is not<\/p>\n<p> defective and is pending consideration.<\/p>\n<p> The impugned Ext.P6 is not one that is liable to<\/p>\n<p> be quashed on ground of any jurisdictional error<\/p>\n<p> since it is issued on the premise of the penalty<\/p>\n<p> proceedings,    which       is  however    pending<\/p>\n<p> consideration   in  Ext.P1     appeal.  The   plea<\/p>\n<p> pointedly projected on behalf of the petitioner<\/p>\n<p> is that if the audit assessment proceedings are<\/p>\n<p> concluded before a final decision is rendered on<\/p>\n<p> the statutory appeal Ext.P1 against the penalty<\/p>\n<p> order, that may prejudice the audit assessment<\/p>\n<p> proceedings. The enquiry and steps taken for<\/p>\n<p> audit assessment are only at their primitive<\/p>\n<p> stage as can be seen from Ext.P6. Following the<\/p>\n<p> direction under (iii) in Ext.P4 judgment, the<\/p>\n<p> petitioner&#8217;s  application    for consideration of<\/p>\n<p> Ext.P1 appeal needs to be adverted to and decided<\/p>\n<p><span class=\"hidden_text\">WP(C)491\/2009            -: 3 :-<\/span><\/p>\n<p> upon by the authority before whom Ext.P1 appeal<\/p>\n<p> is pending. That cannot be delayed. Pending that,<\/p>\n<p> the     petitioner   would      produce  accounts  and<\/p>\n<p> documents      pursuant    to    Ext.P6   notice. The<\/p>\n<p> proceedings of hearing, production of records<\/p>\n<p> etc. in connection with the enquiry and audit<\/p>\n<p> could continue following Ext.P6. However, the<\/p>\n<p> audit      assessment  proceedings     shall   not  be<\/p>\n<p> concluded     by   issuing     final  orders  in  such<\/p>\n<p> proceedings before the issuance of final orders<\/p>\n<p> on      Ext.P1   appeal.       The   audit  assessment<\/p>\n<p> proceedings      will  be      concluded  only   after<\/p>\n<p> adverting to and considering any decision that<\/p>\n<p> may be rendered on Ext.P1 appeal. It is so<\/p>\n<p> directed. The petitioner will produce a copy of<\/p>\n<p> this judgment before the authority before whom<\/p>\n<p> Ext.P1 appeal is pending and also before the<\/p>\n<p> authority who has issued Ext.P6 notice.
