Justice V.GIRI\n\n Dated :28\/08\/2009\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                    W.P.(C).24995\/2009\n                       --------------------\n          Dated this the 28th day of August, 2009\n\n                       JUDGMENT\n<\/pre>\n<p>     The petitioner is the agreement        owner of a vehicle<\/p>\n<p>bearing registration No.KL-11\/V 2826 which was allegedly<\/p>\n<p>seized for infraction of the provisions of the Kerala<\/p>\n<p>Protection of River Banks and Regulation of Removal of sand<\/p>\n<p>Act, 2001. He has approached the District Collector, the 1st<\/p>\n<p>respondent for release of the vehicle and is aggrieved by<\/p>\n<p>the non-consideration of the request.<\/p>\n<p>2.   The nature of the power exercised by the District<\/p>\n<p>Collector and the para meters within which such power is to<\/p>\n<p>be exercised have been dealt with by a Bench of this Court in<\/p>\n<p>Sanjayan Vs.Tahasildar [2007 (4) KLT 597]. Principles<\/p>\n<p>have been reiterated in Subramanian Vs. State of Kerala<\/p>\n<p>[2009 (1) KLT 77).\n<\/p>\n<\/p>\n<p>3.    In Subramanian&#8217;s case, this Court observed that the<\/p>\n<p>power exercised by the District Collector is under Section 23<\/p>\n<p>of the Kerala Protection of River Banks (Protection and<\/p>\n<p>Regulation of removal of sand) Act, 2002.          It is also,<\/p>\n<p>W.P.(C).24995\/09<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>therefore, quasi judicial in character. Reasons will have to<\/p>\n<p>be given by the District Collector     while passing orders<\/p>\n<p>under Section 23 of the Kerala Protection of River Banks<\/p>\n<p>(Protection and Regulation of removal of sand) Act, 2002<\/p>\n<p>r\/w Rules 27 and 28 of Kerala Protection of River Banks<\/p>\n<p>and Regulation of Removal of Sand Rules 2002. If there is<\/p>\n<p>a contention that the transportation of sand was supported<\/p>\n<p>by a pass issued by the competent local authority, that has<\/p>\n<p>to be referred. The materials which are placed before the<\/p>\n<p>District Collector by the subordinate officials shall also be<\/p>\n<p>looked into.    This has been indicated in Subramanian&#8217;s<\/p>\n<p>case. If motion is made by the owners of the vehicle for<\/p>\n<p>release of the vehicle on interim custody, it will be subject<\/p>\n<p>to the conditions mentioned in paragraph 58 of the said<\/p>\n<p>judgment. The District Collector may pass orders on such<\/p>\n<p>applications for     interim custody.  (The    scope of the<\/p>\n<p>directions contained in Subramanian&#8217;s case        have later<\/p>\n<p>been dealt with in <a href=\"\/doc\/925008\/\">Sareesh v. District Collector<\/a> (2009<\/p>\n<p>(2)    KLT      906).  Appropriate clarifications have been<\/p>\n<p>issued in the latter judgment). Further conditions can be<\/p>\n<p>imposed in the course of release of the vehicle as indicated<\/p>\n<p>by this Court in Shoukathali Vs. Tahasildar [2009 (1)<\/p>\n<p>KLT 640].\n<\/p>\n<p>W.P.(C).24995\/09<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>4.    Keeping in mind the      observations made in        the<\/p>\n<p>judgments in Shoukathali&#8217;s case and Subramanian&#8217;s case<\/p>\n<p>and other judgment which have been referred to, the 1st<\/p>\n<p>respondent      shall pass final orders in the matter of<\/p>\n<p>confiscation\/release of the vehicle in question after<\/p>\n<p>conducting an appropriate enquiry as early as possible, at<\/p>\n<p>any rate within three months from the date of receipt of a<\/p>\n<p>copy of this judgment.\n<\/p>\n<\/p>\n<p>5.    In the meanwhile, if motion is made by the petitioner<\/p>\n<p>for interim custody of the vehicle, then      orders shall be<\/p>\n<p>passed by the District Collector on the application for<\/p>\n<p>interim custody of the vehicle, after notice to the registered<\/p>\n<p>owner of the vehicle and after hearing him as well, within<\/p>\n<p>three weeks from the date of receipt of a copy of this<\/p>\n<p>judgment in the light of the observations contained in<\/p>\n<p>Shoukathali Vs. Tahasildar [2009 (1) KLT                 640,<\/p>\n<p>Subramanian Vs. State of Kerala [2009 (1) KLT 77)<\/p>\n<p>and <a href=\"\/doc\/925008\/\">Sareesh v.       District Collector<\/a>    (2009 (2)     KLT<\/p>\n<p>906).\n<\/p>\n<\/p>\n<p>6.    I make it clear    that I have not considered        the<\/p>\n<p>W.P.(C).24995\/09<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>petitioner&#8217;s contentions on merits. It is upto the District<\/p>\n<p>Collector to consider whether the vehicle is to be released<\/p>\n<p>on interim custody or not.      It is also upto the District<\/p>\n<p>Collector to consider, in accordance with law, the question<\/p>\n<p>as to whether the vehicle in question has been used in a<\/p>\n<p>manner as to contravene the provisions of the Act and the<\/p>\n<p>Rules framed thereunder and as to whether the vehicle is<\/p>\n<p>liable for confiscation and pass final orders on that basis.<\/p>\n<p>      The writ petition is    disposed of as above.
