Justice V.GIRI\n\n Dated :27\/05\/2009\n\n O R D E R\n                        V.GIRI, J\n            ---------------------------\n                W.P.(C).32827 of 2008\n            ---------------------------\n         Dated this the 27th day of May, 2009\n\n                      JUDGMENT\n<\/pre>\n<p>           The    petitioner   entered   into    Ext.P1<\/p>\n<p>agreement with the 1st respondent for providing<\/p>\n<p>security personnel for the establishments run by the<\/p>\n<p>1st  respondent.      The   agreement    contains    an<\/p>\n<p>arbitration clause, which reads as follows:<\/p>\n<blockquote><p>           &#8220;In case any dispute the matter may<\/p>\n<p>     left for the arbitration of the Managing<\/p>\n<p>     Director, KSINC and his decision on the<\/p>\n<p>     matter shall be final and binding on both<\/p>\n<p>     parties.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>           2.  The period of agreement is over.      It<\/p>\n<p>seems that the 1st respondent is desirous of engaging<\/p>\n<p>another agency. It further seems, according to the 1st<\/p>\n<p>respondent that the final settlement of the accounts<\/p>\n<p>has not been completed.      Ext.P5 communication is<\/p>\n<p>issued by the 1st respondent proposing to recover the<\/p>\n<p>amount    mentioned     therein  to   enable   the   1st<\/p>\n<p>respondent to recoup the loss allegedly caused.<\/p>\n<\/blockquote>\n<p>Ext.P5 has been challenged in this writ petition.<\/p>\n<p>W.P.(C).32827 of 2008<\/p>\n<p>                           :: 2 ::\n<\/p>\n<p>           3.
