SHAH\n\t\t\n\t\n\n \n\nDate\n: 27\/04\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed for an appropriate writ, order and\/or<br \/>\ndirection, directing the respondent No.1 to take appropriate steps to<br \/>\nprotect and maintain Graveyard situated at Survey Nos.414\/2 and 442\/A<br \/>\nsituated at Village: Shahwadi, Ahmedabad.\n<\/p>\n<p>\t\tIt<br \/>\nis also further prayed for an appropriate writ, order and\/or<br \/>\ndirection, directing respondent No.2 not to encroach and damage the<br \/>\ngraves and repair the damage done to the graves.\n<\/p>\n<p>2.\t\tIn<br \/>\nresponse to the Notice issued by this Court, Mr.Prashant Desai,<br \/>\nlearned Senior Advocate has appeared on behalf of respondent No.1 &#8211;<br \/>\nCorporation and Mr.Ketan Shah, learned advocate has appeared on<br \/>\nbehalf of respondent No.2. Affidavit-in-replies are filed on behalf<br \/>\nof the respective respondents.\n<\/p>\n<p>3.\t\tIt<br \/>\nis stated on behalf of the respondents more particularly on behalf of<br \/>\nrespondent No.1 that so far as land bearing Survey No.442\/A is<br \/>\nconcerned, the same is reserved for Kabarastan and the same shall be<br \/>\npermitted to be used for graveyard and there shall not be any<br \/>\ndisturbance on the aforesaid land for the aforesaid purpose.\n<\/p>\n<p>4.\t\tSo<br \/>\nfar as land bearing Survey No.414\/2 is concerned, the same is already<br \/>\nreserved for the purpose of Sewage treatment plant and thereafter the<br \/>\nsame is given to respondent No.2 under the Memorandum of<br \/>\nUnderstanding -cum- Agreement dated 23\/12\/2010 for financing,<br \/>\nbuilding, operating and maintaining a plant for the production of<br \/>\nfuel Billets and other organic waste into Bio-organic soil Enricher\/<br \/>\norganic fertilises from Mix Municipal Solid Waste at Gyaspur,<br \/>\nAhmedabad.\n<\/p>\n<p>5.\t\tMr.Asthavadi,<br \/>\nlearned advocate appearing on behalf of the petitioner, in the<br \/>\npresence of Mr.Manhar M.Christie, Secretary of the Church of North<br \/>\nIndia, has submitted that in view of the aforesaid, the concerned<br \/>\nrespondents may be directed that existing graves may not be affected<br \/>\nand religious sentiment may not be affected at all.\n<\/p>\n<p>6.\t\tMr.Prashant<br \/>\nDesai, learned Senior Advocate appearing on behalf of respondent No.1\n<\/p>\n<p>&#8211; Corporation and Mr.Ketan Shah, learned advocate appearing on<br \/>\nbehalf of respondent No.2 , under the instructions from the concerned<br \/>\nrespondents, have stated at the bar that all protective steps shall<br \/>\nbe taken by the respondents to protect and maintain existing graves<br \/>\nand they will see that no damage shall be caused to existing graves<br \/>\nsituated on Survey No.414\/2 and in fact they will see to it that some<br \/>\nprotection wall and grills are provided so that there is no damage to<br \/>\nexisting graves at all.   It is also stated by learned advocate<br \/>\nappearing on behalf of the respondents that efforts shall be made by<br \/>\nthe respondents that religious feelings of the concerned persons are<br \/>\nnot affected at all and there are no damage to existing graves.\n<\/p>\n<p>7.\t\tIn<br \/>\nview of the above, the present petition is disposed of by directing<br \/>\nthe concerned respondents to act as stated hereinabove and as per<br \/>\nsettlement made by learned advocate appearing on behalf of respective<br \/>\nrespondents as recorded hereinabove and all concerned to see that no<br \/>\ndamage shall be caused to the existing graves situated on survey<br \/>\nNo.414\/2 and there shall be protective wall therefore, there shall<br \/>\nnot be damage to existing graves and all are directed to see that<br \/>\nreligious feelings of the persons are not affected at all.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present petition is disposed of.
