VARIAVA, J.\n<\/p>\n<p>Leave granted.\n<\/p>\n<p>Heard parties.\n<\/p>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<br \/>\n    This  Appeal is against an Order dated 7th April,  2000.<br \/>\nBy  this Order a Detention Order dated 2nd August, 1999\t has<br \/>\nbeen  quashed  on  the ground that the\tDetention  Order  is<br \/>\nvitiated  on  ground  of vagueness as the  exact  overt\t act<br \/>\nattributable  to  each one of the accused has not  been\t set<br \/>\nout.\n<\/p>\n<p>    We\thave read the Detention Order.\tThe Detention  Order<br \/>\nsets out as follows:\n<\/p>\n<p>    On\t24-6-99 at about 1100 hours Tvi.  Thiruvengadam and<br \/>\nhis  associate\tBaskar\t@ Reddy\t Baskar,  Parthasarathy\t and<br \/>\nKandan\tgot  down from a Tata Sumo car bearing\tRegistration<br \/>\nNo.   TN-01-P  2525.  Thiru Palani noticed them\t armed\twith<br \/>\nknife.\t Thiru Thiruvengadam noticing Thiru Palani came near<br \/>\nThiru  Palani  and  by uttering &#8220;when we  cut  your  brother<br \/>\nRavichandran you went and gave complaint to the police.\t Now<br \/>\nI  am  cutting you.  Let me see who will give complaint\t for<br \/>\nthis.\tYou die with this cut&#8221;, terrorised him and rushed to<br \/>\ncut him over his head.\tThiru.\tPalani warded off the attack<br \/>\nwith  his right hand.  However the knife fell over his right<br \/>\nfore-arm  and  caused bleeding injury to him.  Thiru  Palani<br \/>\nraised\thue  and  cry.\tA huge crowd gathered at  the  spot.<br \/>\nThiru  Thiruvengadam  and  others by brandishing  the  knife<br \/>\nterrorised  everyone  at the spot by uttering &#8220;if  any\tbody<br \/>\ncomes near we will remove the leg, hand&#8221;, and also picked up<br \/>\nsoda  water bottles from the nearby shop of Thiru Srinivasan<br \/>\nand hurled the same against the public.\t The bottles fell on<br \/>\nthe  road  side\t broken into pieces and\t the  broken  pieces<br \/>\nscattered  all\tover  the  roadside.  The  public  who\twere<br \/>\nproceeding  in their vehicles noticed and turned back  their<br \/>\nvehicles  in  the same direction from which they came.\t The<br \/>\nnearby\tshop-owners noticed and closed down their shops\t and<br \/>\nsuspended  their  business.  The normalcy in that  area\t was<br \/>\ntotally dislocated.  Thus they have created terror and panic<br \/>\nat the spot.\n<\/p>\n<p>    In our view, there is no vagueness in the said Detention<br \/>\nOrder.\t The  Detention\t Order\tclearly sets  out  that\t the<br \/>\nRespondent  along  with\t  Thiruvengadam,  Parthasarathy\t and<br \/>\nKandan\tgot down from the Tata Sumo car and that all of them<br \/>\nwere  armed  with knives.  The Detention Order clearly\tsets<br \/>\nout  that  the\tcomplainant was threatened.   The  Detention<br \/>\nOrder sets out these persons terrorised everyone at the spot<br \/>\nand one of them picked up a soda bottle from the nearby shop<br \/>\nand hurled the same against the public.\t The Detention Order<br \/>\nsets  out  that\t the  normalcy of the  area  was  completely<br \/>\ndislocated as terror and panic had been created at the spot.\n<\/p>\n<p>    We fail to see what further and better particulars could<br \/>\nhave  been  given in the Detention Order.  In  the  impugned<br \/>\nOrder  the learned Judge has failed to clarify what  further<br \/>\nand  better  particulars  could\t have\tbeen  given  in\t the<br \/>\nDetention  Order.  In our view, the impugned Order cannot be<br \/>\nsustained and it is accordingly set aside.\n<\/p>\n<p>    However,  the Detention Order was of 1999.\tThe same had<br \/>\nbeen quashed by the High Court in April 2000.  The period of<br \/>\ndetention  is  over.  In our view, this is not a case  where<br \/>\nthe  Detenu  should  be\t made to surrender  to\tundergo\t the<br \/>\nremaining period of detention.\n<\/p>\n<p>    The\t Appeal stands disposed off accordingly.  There will<br \/>\nbe no Order as to costs.\n<\/p>\n<p>(M. B. SHAH)<\/p>\n<p>(S. N.
