Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/01\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.R.P.NO.4015 OF 2008\n              ------------------------------------------\n\n              Dated       222nd January 2009\n\n\n                           O R D E R\n<\/pre>\n<p>         Revision petitioner is the accused                 and first<\/p>\n<p>respondent, the complainant in C.C.79\/2003 on the file<\/p>\n<p>of  Judicial  First       Class       Magistrate,        Kunnamkulam.<\/p>\n<p>Revision petitioner was convicted                    for the offence<\/p>\n<p>under Section 138 of Negotiable Instruments Act and<\/p>\n<p>sentenced  to  simple imprisonment for one year and to<\/p>\n<p>pay  Rs.3,00,000\/-     as    compensation            and  in  default<\/p>\n<p>simple imprisonment for one month. Revision petitioner<\/p>\n<p>challenged    the        conviction              before      Sessions<\/p>\n<p>court,Thrissur in Crl.A.239\/2006. Learned Additional<\/p>\n<p>Sessions  Judge     on       re-appreciation            of   evidence<\/p>\n<p>confirmed the conviction and sentence and dismissed<\/p>\n<p>the appeal. It is challenged in this revision.<\/p>\n<p>    2.   Learned     counsel          appearing         for  revision<\/p>\n<p>petitioner was heard.\n<\/p>\n<p>    3.     Learned counsel appearing for revision                  is<\/p>\n<p>challenging the conviction only on the                    ground that<\/p>\n<p>Judicial First Class Magistrate, Kunnumkulam has no<\/p>\n<p>CRRP 4015\/08<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>jurisdiction    to try the offence. Argument of learned<\/p>\n<p>counsel is that as admitted by the first respondent his<\/p>\n<p>permanent address is at Madras and transaction had taken<\/p>\n<p>place at Madras and therefore, Judicial First Class<\/p>\n<p>Magistrate, Kunnumkulam has no jurisdiction to try the<\/p>\n<p>offence.    Learned  counsel  made  available  copy   of<\/p>\n<p>deposition of first respondent as PW1. Evidence of PW1<\/p>\n<p>shows that he admitted that his permanent address  is at<\/p>\n<p>Madras. But it is his specific case that during the<\/p>\n<p>period when Ext.P1 cheque was issued, he was residing at<\/p>\n<p>Guruvayur at his daughter&#8217;s house. More over,     it is<\/p>\n<p>specific case of revision petitioner that  Ext.P1 cheque<\/p>\n<p>was issued by      revision petitioner from his house at<\/p>\n<p>Palakkad and    first respondent presented the cheque at<\/p>\n<p>the place where he was residing at that time and when it<\/p>\n<p>was dishonoured for want of sufficient funds it was<\/p>\n<p>demanded by sending notice from there. When one of the<\/p>\n<p>five components      for constituting an offence under<\/p>\n<p>Section 138 of Negotiable Instruments Act had taken<\/p>\n<p>place within the jurisdiction of Judicial First Class<\/p>\n<p>Magistrate,    Kunnumkulam,   learned   Magistrate   has<\/p>\n<p>definitely the jurisdiction to try the offence. Hence, I<\/p>\n<p>find no reason to interfere with the conviction on that<\/p>\n<p>CRRP 4015\/08<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>ground.\n<\/p>\n<p>     4.    Judgments  of  courts  below  establish  that<\/p>\n<p>revision petitioner borrowed Rs.3,00,000\/- from first<\/p>\n<p>respondent for his film business        and subsequently<\/p>\n<p>towards its repayment issued Ext.P1 cheque which was<\/p>\n<p>dishonoured   for  want  of    sufficient funds,    when<\/p>\n<p>presented for encashment. It is also proved that first<\/p>\n<p>respondent had complied with all statutory formalities<\/p>\n<p>provided   under  Sections 138  and   142 of  Negotiable<\/p>\n<p>Instruments Act. In such circumstance, conviction of<\/p>\n<p>revision petitioner   for the offence under Section 138<\/p>\n<p>of Negotiable Instruments Act is perfectly legal.<\/p>\n<p>     5.    Then the question is regarding the sentence.<\/p>\n<p>Learned Magistrate awarded a substantive sentence of<\/p>\n<p>simple imprisonment     for one year     in addition to<\/p>\n<p>compensation of Rs.3,00,000\/-.     So   long   as    the<\/p>\n<p>sentence is not     altered or    modified  against the<\/p>\n<p>interest of first respondent, it is not necessary to<\/p>\n<p>issue  notice   to  first  respondent.  As per  sentence<\/p>\n<p>awarded by courts below first respondent is entitled to<\/p>\n<p>compensation of Rs.3,00,000\/-. Considering   the entire<\/p>\n<p>facts and circumstances of the case, interest of justice<\/p>\n<p>will be met, if sentence is modified to imprisonment<\/p>\n<p>CRRP 4015\/08<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>till rising of court and fine with a direction to pay<\/p>\n<p>compensation on realisation of fine to first respondent.<\/p>\n<p>     6.    Revision is allowed in part. Conviction of<\/p>\n<p>revision petitioner for the offence under Section 138 of<\/p>\n<p>Negotiable Instruments Act is confirmed.    Sentence is<\/p>\n<p>modified.    Revision   petitioner   is  sentenced    to<\/p>\n<p>imprisonment   till  rising of   court and  a  fine   of<\/p>\n<p>Rs.3,10,000\/- and in default simple imprisonment for<\/p>\n<p>three months. On realisation of fine   Rs.3,00,000\/- is<\/p>\n<p>to be paid to first respondent as compensation     under<\/p>\n<p>Section 357(1)(b) of Code of Civil Procedure.<\/p>\n<p>     Revision petitioner is granted two months time to<\/p>\n<p>pay the fine.
