BHAVADASAN, JJ.\n                  -------------------------------------------\n                       R.F.A.No.27 OF 2003\n                  -------------------------------------------\n            Dated this the 1st day of November, 2010\n\n\n                             JUDGMENT\n<\/pre>\n<p>Thottathil B.Radhakrishnan, J.\n<\/p>\n<\/p>\n<p>     We have seen the endorsement of the office following the<\/p>\n<p>earlier order. No further notice need be issued.<\/p>\n<p>     This appeal arises from the final decree in a suit for<\/p>\n<p>partition. The short issue arising for decision is as to whether<\/p>\n<p>the appealing defendant had an opportunity to object to the<\/p>\n<p>commissioner&#8217;s report obtained in the final decree proceedings.<\/p>\n<p>According to her, she had filed objections, however, that it was<\/p>\n<p>not considered by the court below.                 As a matter of fact, it<\/p>\n<p>appears that the commissioner&#8217;s report was returned for curing<\/p>\n<p>defects and the learned counsel for the appellant is right in<\/p>\n<p>pointing out that the said objections were obtained from the<\/p>\n<p>court below on return, after the matter was decided and the<\/p>\n<p>same has been placed on record in this court along with<\/p>\n<p>RFA.27\/03<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>I.A.1932\/05. We have seen the said statement of objections with<\/p>\n<p>endorsements and we are satisfied that the matter deserves re-<\/p>\n<p>consideration at the hands of the court below.<\/p>\n<p>      For the aforesaid reasons, the impugned final decree is set<\/p>\n<p>aside and the matter is remitted to the court below to consider<\/p>\n<p>the objections raised by the defendant to the commissioner&#8217;s<\/p>\n<p>report. The said objections are received by this Court and would<\/p>\n<p>stand transmitted forthwith, along with LCR, if received. For this<\/p>\n<p>purpose, I.A.1932\/10 is allowed. Since the respondent did not<\/p>\n<p>appear, the court below will issue notice to that party.     The<\/p>\n<p>appellant is directed to appear before the court below on<\/p>\n<p>1.12.2010.
