SHARMA, J (ORAL)<\/p>\n<p>          This regular second appeal by the State of Haryana is<\/p>\n<p>directed against the judgment and decree dated 7.4.2007 passed by the<\/p>\n<p>learned lower appellate Court decreeing the suit filed by the<\/p>\n<p>plaintiff\/respondent No. 1.\n<\/p>\n<p>          The plaintiff\/respondent No. 1 brought a suit for declaration<\/p>\n<p>and injunction claiming that she was entitled to service dues of Anil<\/p>\n<p>Kumar her deceased son, who died during service.<\/p>\n<p>          The dispute was between Smt. Raj Rani i.e. widowed mother<\/p>\n<p>of Anil Kumar and respondent No. 2 i.e widow of Anil Kumar.<\/p>\n<p>          The learned trial Court decreed the suit for half of the amount<\/p>\n<p>by holding that mother was also required to be included as member of<\/p>\n<p>family being class one heir and thus entitled to retiral benefits along with<\/p>\n<p>respondent No. 2.\n<\/p>\n<p>          A Division Bench of this Court in the case of State of Punjab<br \/>\n R.S.A. No. 2127 of 2007 (O&amp;M)<br \/>\n<span class=\"hidden_text\">                                                                   -2-<\/span><\/p>\n<p>and another Vs. Kharak Singh Kang and another, 1998(1) RSJ 412,<\/p>\n<p>Single Bench of this Court in Lichhami Devi Vs. State of Haryana,<\/p>\n<p>2001(3) RSJ 675 and Phool Pati Vs. Haryana State Electricity Board<\/p>\n<p>(Operation) now re-designated as Dakshin Haryana Vidyut Parsarn<\/p>\n<p>Nigam Limited, Hisar, 2002(2) PLR 727 has been pleased to lay down<\/p>\n<p>the definition of the &#8216;family&#8217; as given in rules to be ultra vires the<\/p>\n<p>Constitution as widowed mother who is falling in &#8220;Class-1 heir&#8221; as per<\/p>\n<p>schedule of succession could not be excluded from the family.<\/p>\n<p>          Two appeals were filed against the judgment and decree, one<\/p>\n<p>by State of Haryana and other by respondent No. 1.<\/p>\n<p>          The State challenged the decree on the plea that the<\/p>\n<p>judgment and decree passed is contrary to rules, whereas respondent<\/p>\n<p>No. 1 challenged the judgment and decree by claiming full amount on<\/p>\n<p>the plea that respondent No. 2 has remarried and, therefore, was not<\/p>\n<p>entitled to any benefit.\n<\/p>\n<p>          The learned lower appellate Court has been pleased to<\/p>\n<p>accept the appeal filed by respondent No. 1, whereas the appeal filed<\/p>\n<p>by the State was ordered to be dismissed.\n<\/p>\n<p>          Learned Sr. D.A.G., Haryana, has raised the following<\/p>\n<p>substantial question of law for decision by this Court: &#8211;<\/p>\n<blockquote><p>          &#8220;Whether the learned Courts below were justified in<br \/>\n          decreeing the suit by ignoring the rules governing the<br \/>\n          service conditions of Anil Kumar?&#8221;<\/p><\/blockquote>\n<p>          The substantial question of law raised does not arise as the<\/p>\n<p>same stands settled by this Court in State of Punjab and another Vs.<\/p>\n<p>Kharak Singh Kang and another, 1998(1) RSJ 412, Lichhami Devi<\/p>\n<p>Vs. State of Haryana, 2001(3) RSJ 675 and Phool Pati Vs. Haryana<\/p>\n<p>State Electricity Board (Operation) now re-designated as Dakshin<\/p>\n<p>Haryana Vidyut Parsarn Nigam Limited, Hisar, 2002(2) PLR 727<br \/>\n R.S.A. No. 2127 of 2007 (O&amp;M)<br \/>\n<span class=\"hidden_text\">                                                                     -3-<\/span><\/p>\n<p>holding that mother is also entitled to benefits and once respondent No.<\/p>\n<p>2 has remarried, she could not be treated to be member of the family to<\/p>\n<p>claim any amount.\n<\/p>\n<p>         Consequenlty, no fault can be found with judgment and<\/p>\n<p>decree passed by the learned lower appellate Court.<\/p>\n<p>         No merit.\n<\/p>\n<p>         Dismissed.\n<\/p>\n<p>                                                 (Vinod K.
