working” a\u00e9”, a~5 cleaner in lorry bearing<\/p>\n
;E No.MEd74545: On QCEUEZOOZ when he was proceeding<\/p>\n
‘on’EEanqa;\u00a2r\u00e9rMyaore Road near Kengeri Upanagar<\/p>\n
Circ\u00a7\u00e9 the iarry in which he was travelling met<\/p>\n
V2__ with an accident with another lorry, which came<\/p>\n
E framEgthe opposite direction in a rash and<\/p>\n
‘\ufb01he@;i\u00a7ent manner. Due to the said impact the<\/p>\n
“gciaimant suffered grievous injuries all over his<\/p>\n
‘Jbody and the lorry was also totally damaged. It<\/p>\n

is the case of the claimant that “he “Qasu<\/p>\n
immediately shifted to Sahana Hospitalfehereiheilu<\/p>\n
was examined and treated tux admitting lt\ufb01a as an’<\/p>\n
inpatient. It is his case that when he was in7a<\/p>\n
the Sahana Hospital X-rays were .tatend~whieh<\/p>\n
reveal fracture of right led and also damage to
\nvertebra L3 to L5; \u00a5t’THer@att5?r in the said
\nHospital operation was dcondaetedldtthe fracture
\nwas united with the tel? of i\ufb01nlants and POP was
\napplied. it is his eggs that he had spent nearly
\nRs . 50, 0:36″\/”x4; ‘A — Ifgrwit :7’; after initial
\ntreatment. for– ten Vda\ufb01sg he was shifted to<\/p>\n
Government t\ufb01ospitalg for further treatment and<\/p>\n
“<after\u00a7\u20actating treatment in the said Hospital he<\/p>\n
Vlwas advised to take rest. It is his case that he<\/p>\n
is the onl\u00a7=earning member in the family and as<\/p>\n
~advised by the Doctor he had to undergo one more<\/p>\n
d* operation in future for removal of implants and<\/p>\n
lrhezhas to be careful due to the injury that he<\/p>\n
ddhas: suffered in the accident. It is his case<\/p>\n
""that due to mental shock and agony and also due<\/p>\n

5. On appreciation of the pleadinge,
\nevidence and also after hearing the parties, the<\/p>\n
Tribunal partially ailowed the claim of the<\/p>\n
petitioner by awarding a sum. of Rs.41,00Qfrd;a3i<\/p>\n
compensation with interest at 6% per lehnumid\ufb02<\/p>\n
payable from the date of petition t_il’lv-iidate of<\/p>\n
realisation. The claimant being aggrie\u00a7ed\u00a5hyVthe,i<\/p>\n
meager amount of compensation that is awarded to”<\/p>\n
him has come up in this appeal claiming that the<\/p>\n
quantum of compensation awarded is on lower side<\/p>\n
compared “\u00a3o= the Vg\ufb01jgries that he has suffered,
\nwhich according to him has resulted in permanent
\ndisability to himg_l<\/p>\n
“~a.\u00bb:n this appeal the 1”: respondent entered<\/p>\n
appearance through its counsel and notice to 2″‘<\/p>\n
\u00abrespondent ie dispensed with. Heard the learned<\/p>\n
ililCounael for the parties.\n<\/p>\n
7. It is the case of the appellant that the<\/p>\n
A “”compound fractures of right tibia upper end and<\/p>\n

also the fracture of “f\u00a7 to L5 vertebra have<\/p>\n
rendered him totally’ disabled to do any” manual<\/p>\n
work. It is his case that he being a cleaner inN<\/p>\n
a lorry he is fit to do only manual work and eith\ufb02h”<\/p>\n
the kind of injuries that he has-suffered; he is”<\/p>\n
not able to continue the same in f\ufb01tureaand he i37l<\/p>\n
not able to earn substantially for maintenance of
\nhis family. His further case is taatjge is the
\nonly earning member in hie faeily ego the amount
\nof compensation, that His .aearde8{ to* him is on<\/p>\n
lower sia\u00e9;-fg;t {is “seen ‘that the appellant is
\naged 20 years at the time of accident and he had<\/p>\n
a large family to take care of by his earnings<\/p>\n
*<and [the linjuries "to …. his leg and to vertebra<\/p>\n
ilreo\ufb01cedahisvability to do work. Considering the<\/p>\n
fact that he is illiterate, he is not capable of<\/p>\n
.doin\u00e9 any other work than the work which involves<\/p>\n
l9h\u00a5$ioall exertion and xnanual labour and in the<\/p>\n
:riight"of the injuries that he has suffered to his<\/p>\n
ilvertebra and also to the left tibia, he may not<\/p>\n

out his livelihood and also earn income, this<\/p>\n
Court is of the opinion that the amount _of<\/p>\n
compensation that is awarded by the Trib\ufb01nal is N<\/p>\n
meager. It is seen that the claimant hh\u00a7em’no\u00a7ui<\/p>\n
adduced evidence regarding the injnry that he;has:\ufb02<\/p>\n
suffered and the disability that _has jcausedi\ufb01toid<\/p>\n
him due to the injury. Therefore;’in*thea\u00e9hh\u00e9nce
\nof an expert opinion by the Ddotor in this hehalf
\nthe Tribunal has fixed \u00bbhn n\u00a7hgn\u00a7= amount of
\ncompensation, which is reduired to be enhanced.<\/p>\n
sf The Ttinnhai”a\u00a7ard\u00e9d a sum of Rs.3,ooo\/~<\/p>\n
as compensation fohdthe.period when he was laid~<\/p>\n
_ up age to the injhries. Admittedly, the accident<\/p>\n

in Bangaiore City he would have earned a minimum<\/p>\n

compensationd awarded uander the head incidental<\/p>\n
