Justice ANTONY DOMINIC\n\n Dated :16\/01\/2009\n\n O R D E R\n                          ANTONY DOMINIC, J.\n                           ---------------------------\n                        W.P.(C) No. 24420 of 2008\n                       ------------------------------------\n                Dated this the 16th day of January, 2009\n\n                                 JUDGMENT\n<\/pre>\n<p>      Petitioner is a contractor.         He was awarded three different<\/p>\n<p>Government Contracts by the first respondent and Exhibits P2, P3 and<\/p>\n<p>P4 are the contracts. The work has been executed by the petitioner and<\/p>\n<p>the petitioner is relying on Exhibits P5, P6 and P7 completion<\/p>\n<p>certificates. However, payment was not released. Reasons stated in the<\/p>\n<p>counter affidavit filed by the 3rd respondent is that the District<\/p>\n<p>Collector omitted to countersign the agreement of the works executed<\/p>\n<p>between the petitioner and the first respondent.<\/p>\n<p>      A reading of counter affidavit shows that the petitioner has<\/p>\n<p>admittedly executed the work and amount claimed is actually due. It is<\/p>\n<p>also stated that if this court issues an order for payment, payment will<\/p>\n<p>be released.\n<\/p>\n<p>      Taking into account the fact that admittedly the work has been<\/p>\n<p>completed and the amount is due, it is ordered that the amount due to<\/p>\n<p>the petitioner for the execution of the work in terms of contract, shall<\/p>\n<p>W.P.(C) No. 24420 \/2008<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>be paid to the petitioner ignoring the fact that Collector has not<\/p>\n<p>countersign the agreement for payment ought to be released by the first<\/p>\n<p>respondent, as expeditiously as possible, at any rate within four weeks<\/p>\n<p>of production of copy of this judgment.\n<\/p>\n<p>       Petitioner shall produce a copy of this judgment before the first<\/p>\n<p>respondent for compliance.\n<\/p>\n<\/p>\n<p>                                ANTONY DOMINIC, JUDGE<\/p>\n<p>scm<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court G.Sasidharakurup vs The Executive Engineer on 16 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 24420 of 2008(F) 1.
