JUSTICE AKHILESH CHANDRA\n\n\nAkhilesh                    Heard learned counsel for the appellant and\nChandra, J.\n<\/pre>\n<p>              respondent.\n<\/p>\n<p>                            2. This appeal has been preferred by the appellant<\/p>\n<p>              against order dated 04th December, 2002 passed by Subordinate<\/p>\n<p>              Judge, First , Patna in Miscellaneous Case no.23 of 1998<\/p>\n<p>              dismissing the same on contest and refusing to set aside ex-<\/p>\n<p>              parte judgment and decree passed in Title Suit no.589 of 1990<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>in the year 1993.\n<\/p>\n<p>             3. The relevant and admitted short facts of this<\/p>\n<p>case is that respondent had filed the suit bearing no. 589 of 1990<\/p>\n<p>for specific performance of contract against the appellant who<\/p>\n<p>did not contest the suit.     It was decreed ex-parte and the<\/p>\n<p>execution proceeding was initiated. As per appellant he got<\/p>\n<p>information of the suit and filed the Miscellaneous case seeking<\/p>\n<p>relief for setting aside the decree on the ground that he had not<\/p>\n<p>been served with any type of summon or notice at any point of<\/p>\n<p>time, had sufficient cause for non-appearance \/ participation in<\/p>\n<p>the suit. There was another suit between the parties at Gaya<\/p>\n<p>wherein the plaintiff-respondent was defendant and he also filed<\/p>\n<p>written statement there. It is the case of respondent-opposite<\/p>\n<p>party that since beginning the appellant had knowledge of the<\/p>\n<p>suit,   summons     were duly served by all possible means,<\/p>\n<p>through process server of the court, registered post and by<\/p>\n<p>publication in daily news paper, Hindustan Times. Further in<\/p>\n<p>written statement filed in the suit at Gaya he had annexed the<\/p>\n<p>judgment and decree of the suit but no step was taken by the<\/p>\n<p>appellant . He does not deserve condonation of delay of five<\/p>\n<p>years caused in filing of the Miscellaneous case.<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>              4. Miscellaneous Case no.23 of 1998 was hotly<\/p>\n<p>contested.   Both the sides produced oral and documentary<\/p>\n<p>evidence. On behalf of opposite party-respondent following<\/p>\n<p>were the documents:\n<\/p>\n<blockquote><p>             &#8221; Exhibit-A. &#8211;   Service report of T.S. 589\/90<br \/>\n              Exhibit A\/1-    Paper Publication<br \/>\n              Exhibit-B-      Power<br \/>\n              Exhibit-C-      Inspection Slip<br \/>\n              Exhibit-C\/1-    Service report of Process Server<br \/>\n              Exhibit-D-      Written Statement<br \/>\n              Exhibit-E-       Forwarding Letter with objection.\n<\/p><\/blockquote>\n<pre>              Exhibit-E\/1-     Notice without objection\n              Exhibit-F -     Writing and signature of Braj\n                               Bihari Singh, Adv. on power.\"\n\n<\/pre>\n<blockquote><p>              5. It was also case of the appellant that on service<\/p>\n<p>of notice in execution proceeding he got the record inspected<\/p>\n<p>soon thereafter filed in Miscellaneous Case. On behalf of the<\/p>\n<p>appellant there are two documents, Exhibit-1 Vakalatnama and<\/p>\n<p>Exhibit-2 Inspection slip filed on 06.08.1998. The plaintiff-\n<\/p><\/blockquote>\n<p>respondent has also taken a view that in 1993 on behalf of the<\/p>\n<p>appellant there was an inspection slip by engaging another<\/p>\n<p>lawyer and he, by virtue of that, also had information of suit and<\/p>\n<p>its proceeding but inspite of that no step was taken. All such<\/p>\n<p>completely disentitles him for the relief claimed.<\/p>\n<p>              6. During the course of argument learned counsel<\/p>\n<p>for the appellant, by placing reliance upon decision of the Apex<br \/>\n<span class=\"hidden_text\">                      4<\/span><\/p>\n<p>Court in the case of <a href=\"\/doc\/295872\/\">G.P. Srivastava V. R.K. Raizada,<\/a> (2000)<\/p>\n<p>3 S.C.C. 54; submitted that unless it is shown that defendant<\/p>\n<p>has specific information by service of notice about the date of<\/p>\n<p>hearing ex-parte decree cannot sustain. In paragraph 7 of the<\/p>\n<p>judgment the Apex Court has said like this:\n<\/p>\n<\/p>\n<blockquote><p>             &#8220;7. Under Order 9 Rule 13 CPC an ex parte decree<br \/>\n              passed against a defendant can be set aside upon<br \/>\n              satisfaction of the Court that earlier the summons<br \/>\n              were not duly served upon the defendant or he<br \/>\n              was prevented by any &#8220;sufficient cause&#8221; from<br \/>\n             appearing when the suit          was called on for<br \/>\n             hearing. Unless &#8220;sufficient cause&#8221; is shown for<br \/>\n             non-appearance of the defendant in the case on<br \/>\n             the date of hearing, the court has no power to set<br \/>\n             aside an ex parte decree. The words &#8220;was<br \/>\n             prevented by any sufficient cause from<br \/>\n             appearing&#8221; must be liberally construed to enable<br \/>\n             the court to do complete justice between the<br \/>\n             parties particularly when no negligence or<br \/>\n             inaction is imputable to the erring party.<br \/>\n             Sufficient cause for the purpose of Order 9 Rule<br \/>\n             13 has to be construed as an elastic expression for<br \/>\n             which no hard and fast guidelines can be<br \/>\n             prescribed. The courts have a wide discretion in<br \/>\n             deciding the sufficient cause keeping in view the<br \/>\n             peculiar facts and circumstances of each case.<br \/>\n             The &#8220;sufficient cause&#8221; for non-appearance refers<br \/>\n             to the date on which the absence was made a<br \/>\n             ground for proceeding ex parte and cannot be<br \/>\n             stretched to rely upon other circumstances<br \/>\n             anterior in time. If &#8220;sufficient cause&#8221; is made out<br \/>\n             for non-appearance of the defendant on the date<br \/>\n             fixed for hearing when ex parte proceedings were<br \/>\n             initiated against him, he cannot be penalized for<br \/>\n             his previous negligence which had been<br \/>\n             overlooked and thereby condoned earlier. In a<br \/>\n<span class=\"hidden_text\">                       5<\/span><\/p>\n<p>              case where the defendant approaches the court<br \/>\n              immediately and within the statutory time<br \/>\n              specified, the discretion is normally exercised in<br \/>\n              his favour, provided the absence was not mala<br \/>\n              fide or intentional. For the absence of a party in<br \/>\n              the case the other side can be compensated by<br \/>\n              adequate costs and the lis decided on merits.&#8221;<\/p><\/blockquote>\n<p>             7. Learned counsel further relied on the decision<\/p>\n<p>of the Apex Court in the case of <a href=\"\/doc\/1528815\/\">Sushil Kumar Sabharwal V.<\/p>\n<p>Gurpreet Singh, A.I.R.<\/a> 2002 S.C. 2370; wherein in paragraph<\/p>\n<p>11 it has been held as such :\n<\/p>\n<\/p>\n<blockquote><p>              &#8220;11. The High Court has overlooked the second<br \/>\n              proviso to Rule 13 of O. 9, C.P.C., added by the<br \/>\n              1976 amendment which provides that no Court<br \/>\n              shall set aside a decree passed ex parte merely on<br \/>\n              the ground that there has been an irregularity in<br \/>\n              the service of summons if it is satisfied that the<br \/>\n              defendant had notice of the date of hearing and<br \/>\n              had sufficient time to appear and answer the<br \/>\n              plaintiff\u201fs claim. It is the knowledge of the \u201ethe<br \/>\n              date of hearing\u201f and not the knowledge of<br \/>\n              \u201ependency of suit\u201f which is relevant for the<br \/>\n              purpose of the proviso above said. Then the<br \/>\n              present one is not a case of mere irregularity in<br \/>\n              service of summons; on the facts; it is a case of<br \/>\n              non-service of summons. The appellant has<br \/>\n              appeared in the witness-box and we have<br \/>\n              carefully perused his statement. There is no<br \/>\n              cross-examination directed towards discrediting<br \/>\n              the testimony on oath of the appellant, that is, to<br \/>\n              draw an inference that the appellant had in any<br \/>\n              manner a notice of the date of hearing and had<br \/>\n              sufficient time to appear and answer the<br \/>\n              plaintiff\u201fs claim which he did not avail and<br \/>\n              utilize.&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\">                      6<\/span><\/p>\n<p>             8. Further reliance has been placed on a decision<\/p>\n<p>of this Court in the case of Parshuram Pathak V. Smt. Shiv<\/p>\n<p>Kumari Kuer, 2001 (1) P.L.J.R. 428; wherein also almost<\/p>\n<p>similar view was taken.\n<\/p>\n<p>             9. On the basis of all the above decisions it was<\/p>\n<p>contended that there is nothing on record to show any valid<\/p>\n<p>service upon the defendant appellant.        Undisputedly, the<\/p>\n<p>process server, who is said to have visited the house of the<\/p>\n<p>appellant along with summons, never met the appellant but as<\/p>\n<p>per his report marked Exhibit-C\/1 notice was hanged on the<\/p>\n<p>wall. There is further nothing on record by way of exhibit to<\/p>\n<p>show that any step was taken for summon on defendant-<\/p>\n<p>appellant through registered post. No doubt, there is paper<\/p>\n<p>cutting to show that notice was published in the newspaper but<\/p>\n<p>again there is nothing on record to show that defendant had any<\/p>\n<p>such knowledge. So far filing of written statement in another<\/p>\n<p>case annexed with copy of ex parte judgment and decree is<\/p>\n<p>concerned, it is the case of appellant that he was fighting that<\/p>\n<p>case through his counsel and had no occasion to go through<\/p>\n<p>such papers. This much he had stated by examining himself as<br \/>\n<span class=\"hidden_text\">                       7<\/span><\/p>\n<p>A.W.1 also.\n<\/p>\n<p>              10. Learned counsel for the plaintiff-respondent<\/p>\n<p>contends that there was proper service upon the defendant, even<\/p>\n<p>by registered post but in absence of any paper brought on the<\/p>\n<p>record of the Miscellaneous Case by way of postal receipt,<\/p>\n<p>endorsement of postal peon, if notice was returned unserved or<\/p>\n<p>refused or on any other count it is difficult to accept that any<\/p>\n<p>step for notice through registered post was taken.       It is also<\/p>\n<p>vehemently contended that notice was published in newspaper<\/p>\n<p>and it is to be presumed that defendant must have gone through<\/p>\n<p>it. All such presumption are rebuttable. The decision of Apex<\/p>\n<p>Court in the case of <a href=\"\/doc\/1136418\/\">Basant Singh V. Roman Catholic<\/p>\n<p>Mission,<\/a> 2002 (4) P.L.J.R. 186 ; reliance whereon has been<\/p>\n<p>placed by learned counsel is not applicable in this case. Before<\/p>\n<p>the Apex Court in the above case there was ample evidence to<\/p>\n<p>show that notices through registered post were sent and Court<\/p>\n<p>was convinced that notice was served only thereafter without<\/p>\n<p>any order of the trial court notice was published in newspaper<\/p>\n<p>that was nothing but irregularities in notice and on that point<\/p>\n<p>the ex-parte decree was not liable to be set aside but here, in the<\/p>\n<p>instant case, as stated above, there is nothing to show that any<br \/>\n<span class=\"hidden_text\">                       8<\/span><\/p>\n<p>step was taken for service     of summons through registered<\/p>\n<p>posts, so there is no reason to accept service of summon by<\/p>\n<p>such means.\n<\/p>\n<p>              11. There is one document by way of Exhibit-B,<\/p>\n<p>that is, the Vakalatnama said to have been executed by the<\/p>\n<p>appellant in the year 1993 the appellant has simply denied filing<\/p>\n<p>of such Vakalatnama by him and the signature thereon. None<\/p>\n<p>of the parties took any step to get the alleged signature of the<\/p>\n<p>appellant thereon compared with other admitted signature. In<\/p>\n<p>this regard it is submitted by learned counsel for the appellant<\/p>\n<p>that he is to simply deny.     It was the duty of respondent<\/p>\n<p>opposite party to get the same examined by expert whereas just<\/p>\n<p>reverse is the contention of learned counsel for the respondent.<\/p>\n<p>According to him he has brought the power on record and it is<\/p>\n<p>the duty of appellant to specifically get the same examined if he<\/p>\n<p>has denied the signature.\n<\/p>\n<p>              12. From the impugned order it appears that court<\/p>\n<p>below though heavily relied upon this document but also was<\/p>\n<p>not very much keen to do some personal comparison with<\/p>\n<p>specific admitted document. Signature of the appellant on this<\/p>\n<p>document, Exhibit-B, if compared by naked eyes with his<br \/>\n<span class=\"hidden_text\">                       9<\/span><\/p>\n<p>signature on deposition as A.W.1. Prima facie with certain<\/p>\n<p>natural variation appears to be same but in absence of any<\/p>\n<p>scientific test to arrive at any definite conclusion. Had either of<\/p>\n<p>the side taken pains at appropriate stage, position could have<\/p>\n<p>been different.\n<\/p>\n<p>              13. It is also to be taken care of that original suit<\/p>\n<p>was filed in the year 1990, already travelled to twenty odd<\/p>\n<p>years without any positive result. If at this stage, the case is<\/p>\n<p>remitted, for such test etc. it may cause further prejudice and<\/p>\n<p>loss to both the sides besides undue encumbrance         upon the<\/p>\n<p>judicial system. In that view of the matter, it seems desirable<\/p>\n<p>that ex-parte decree of the trial court be set aside and appellant<\/p>\n<p>be given an opportunity to file his statement, contest the suit but<\/p>\n<p>at the same time none of the parties be given any room for<\/p>\n<p>causing further delay and simultaneously the appellant must<\/p>\n<p>compensate the loss causes to the respondent as well as judicial<\/p>\n<p>system, for the delay caused and prima facie laches on his part.<\/p>\n<p>              14. However, in view of the above, this appeal<\/p>\n<p>stands allowed subject to cost of Rs.25,000\/-, out of which<\/p>\n<p>Rs.5,000\/- shall go to High Court Legal Services Authority and<\/p>\n<p>Rs.20,000\/- shall be paid to the plaintiff-respondent.        The<br \/>\n<span class=\"hidden_text\">                      10<\/span><\/p>\n<p>amount must be paid within thirty days from today. Any failure<\/p>\n<p>in compliance shall be treated as dismissal of this appeal. Party<\/p>\n<p>shall appear before the court below on 20th Augusts, 2010 and<\/p>\n<p>the defendant appellant shall file his written statement,<\/p>\n<p>documents relied upon and list of witnesses, if any, positively<\/p>\n<p>within fifteen days of appearance on 20th August, 2010.      The<\/p>\n<p>Court below is directed to dispose of the suit preferably within<\/p>\n<p>six months even by proceeding on day to day basis.
