The referring Bench noticed a<br \/>\njudgment of this Court in the case of Shyam Nandan Prasad &amp; Ors.<br \/>\nvs. State of Bihar &amp; Ors. (1993 (4) SCC 255) which held that<br \/>\ncompliance of Rule (4) is not only mandatory but a notice of the<br \/>\nsaid enquiry should also be given to the land owners concerned.<br \/>\nThe said judgment had noticed three earlier judgments of this<br \/>\nCourt in the case of <a href=\"\/doc\/830852\/\">State of Gujarat &amp; Anr. vs. Patel Chaturbhai<br \/>\nNarsibhai &amp; Ors.<\/a> (1975 (1) SCC 583), <a href=\"\/doc\/1675739\/\">State of Gujarat &amp; Ors. vs.<br \/>\nAmbalal Haiderbhai &amp; Ors.<\/a> (1976 (3) SCC 495) and <a href=\"\/doc\/1217738\/\">General<br \/>\nGovernment Servants Cooperative Housing Society Ltd., Agra vs.<br \/>\nShri Wahab Uddin &amp; Ors.<\/a> (1981 (2) SCC 352) which also took<br \/>\nsimilar views.\n<\/p>\n<p>\tThe referring Bench, however, felt that though the enquiry<br \/>\nunder Rule (4) is mandatory, issuance of notice to the land owners<br \/>\nof such enquiry is not mandatory, because they will anyway be<br \/>\nheard in Section 5A (L.A Act) enquiry even in regard to the<br \/>\nvalidity of the acquisition in favour of a company.\n<\/p>\n<p>It is in view of the above doubt entertained by the Division<br \/>\nBench the matter is referred to a larger Bench.\n<\/p>\n<p>So far as the judgments of this Court cited herein above are<br \/>\nconcerned, they do hold that Rule (4) is not only mandatory but<br \/>\nthat the notice of the said enquiry has to be given to the land<br \/>\nowners. The above judgments, however, have not taken into<br \/>\nconsideration an earlier 5-Judge Bench judgment of this Court in<br \/>\nthe case of <a href=\"\/doc\/463201\/\">Babu Barkya Thakur vs. The State of Bombay &amp; Ors.<\/a><br \/>\n(1961 (1) SCR 128) wherein this Court indicated that all the<br \/>\nrequirements of Part VII of the Act especially Section 40 could be<br \/>\nconsidered in Section 5A enquiry itself which would include all<br \/>\nand any objection of the land owners including the objection in<br \/>\nregard to the acquisition in favour of a company. This judgment of<br \/>\nthe 5-Judge Bench of this Court in our view seems to support the<br \/>\ndoubt entertained by the referring Bench.\n<\/p>\n<p>We have heard the learned counsel for the parties and we are<br \/>\nalso of the opinion that since the objections that could possibly be<br \/>\nraised in Rule (4) enquiry can also be raised in a Section 5A<br \/>\nenquiry and in the absence of any specific requirement in Rule (4)<br \/>\nas to the issuance of notice to the land owners of being heard in<br \/>\nsuch an enquiry, hearing the land owners at the stage of Rule (4)<br \/>\nenquiry would lead only to duplication and cause delay. Since the<br \/>\njudgment of this Court in the case of <a href=\"\/doc\/830852\/\">State of Gujarat vs. Patel<br \/>\nChaturbhai Narsibhai<\/a> (supra) and <a href=\"\/doc\/1675739\/\">State of Gujarat vs. Ambalal<br \/>\nHaiderbhai<\/a> (supra) as also the judgment of General Government<br \/>\n(supra) are judgments of 3-Judge Bench and the said Bench having<br \/>\nnot noticed the observations of this Court in the case of Babu<br \/>\nBarkya Thakur (supra).
