Mr. Maulik Nanavati, learned APP waives service of Rule on<br \/>\nbehalf of the respondent &#8211; State.\n<\/p>\n<p>2.\tThis<br \/>\nApplication is filed under by the applicant under Section 438 Cr.<br \/>\nP.C. in connection with CR No. I-55 of 2011 registered with Mandvi<br \/>\nPolice Station,  Dist. Kutch, for the offences punishable under<br \/>\nSections 465, 467, 468, 471, 406, 420, 419, 120(B) I.P. Code.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned Counsel for the parties. Learned Counsel for the parties do<br \/>\nnot press for reasoned order.\n<\/p>\n<p>4.\tHaving<br \/>\nheard the learned Counsel for the parties and perusing the record and<br \/>\nconsidering the facts of the case, I am inclined to grant<br \/>\nanticipatory bail to the applicant.\n<\/p>\n<p>5.\tIn<br \/>\nthe result, this Application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant CR No. I &#8211; 55<br \/>\nof 2011, registered with Mandvi Police Station, Dist. Kutch, the<br \/>\napplicant shall be released on Bail on his furnishing a Bond of<br \/>\nRs.10,000\/- (Rupees ten thousand only) with one surety of like amount<br \/>\non condition that &#8211;\n<\/p>\n<p>a)\the<br \/>\nshall co-operate with the investigation and \tmake himself available<br \/>\nwhenever required;\n<\/p>\n<p>b)\the<br \/>\nshall remain present before the Investigating \tOfficer, Mandvi Police<br \/>\nPolice Station, Mandvi, \ton 8th<br \/>\nSeptember, 2011 at 11.00 am.\n<\/p>\n<p>he<br \/>\n\tshall not hamper the investigation in any manner nor shall directly<br \/>\n\tor indirectly make any inducement, threat or promise to any witness<br \/>\n\tso as to dissuade them for disclosing such facts to the Court or to<br \/>\n\tany Police Officer;\n<\/p>\n<p>At<br \/>\n\tthe time of execution of Bond, he shall furnish his address to the<br \/>\n\tI.O. and the Court concerned and shall not change the residence till<br \/>\n\tthe final disposal of the case or till further orders;\n<\/p>\n<p>e)\tthat<br \/>\nhe will not leave India without the \tpermission of the Court and, if<br \/>\nis holding a \tPassport, surrender the same before the trial \tCourt<br \/>\nimmediately;\n<\/p>\n<p>f)\tIt<br \/>\nwould be open to the Investigating Officer to \tfile an application<br \/>\nfor remand, if he considers \tit just and proper and the concerned<br \/>\nMagistrate \twould decide it on merits;\n<\/p>\n<p>g)\tthis<br \/>\norder will be operative if the applicant is \tarrested at any time<br \/>\nwithin a period of 90 days;\n<\/p>\n<p>h)\twithin<br \/>\na period of ten days from the date of \tarrest, the applicant shall<br \/>\napply for regular \tbail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without \tbeing influenced by<br \/>\nthe fact that anticipatory \tbail was granted.\n<\/p>\n<p>6.\tWith<br \/>\nthese directions, this Criminal Miscellaneous Application is disposed<br \/>\nof. Rule is made absolute.
