K. Shah, waives service of notice of rule on<br \/>\nbehalf of State.\n<\/p>\n<p>2.\t\tThis<br \/>\nis an application under Section 439 of Criminal Procedure Code<br \/>\npraying for regular bail in connection with offence registered with<br \/>\nBopal Police Station, Ahmedabad (Rural)  vide C.R.No.I-35 of 2011 for<br \/>\nthe offences punishable under 406, 420, 465, 467, 468, 471, 120B and<br \/>\n114 of the Indian Penal Code.\n<\/p>\n<p>3.\t\tIt<br \/>\nis the case of the prosecution that accused applicant herein forged<br \/>\nthe signature of first informant&#8217;s father and prepared power of<br \/>\nattorney dated 28.03.2008. On the strength of bogus Power of Attorney<br \/>\nprepared by accused applicant, he executed registered sale deed<br \/>\nbearing number 12694 in favour of Sudarshan Gupta.  On 04.03.2010,<br \/>\nSudarshan issued public advertisement for the purpose of title<br \/>\nclearance for the above land and at that time first informant learnt<br \/>\nthat his property has been transferred illegally.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned Advocate Mr.Buch appearing with Mr.Jhala for the<br \/>\napplicant and learned APP,  I am persuaded to exercise discretion in<br \/>\nfavour of the applicants taking into consideration following aspects<br \/>\n:-\n<\/p>\n<p>(i)\tIt<br \/>\nis brought to my notice that registered sale deed bearing number<br \/>\n12694 which was executed by present applicant on the strength of<br \/>\nbogus power of attorney has been cancelled.\n<\/p>\n<p>(ii)\tLand<br \/>\nin question has gone back to first informant and he is in possession<br \/>\nof the same.\n<\/p>\n<p>(iii)\tOffences<br \/>\nare magistrate triable offence.\n<\/p>\n<p>(iv)\tInvestigation<br \/>\nis over and charge sheet has been filed.\n<\/p>\n<p>(v)\tEntire<br \/>\ncase is based on documentary evidence.\n<\/p>\n<p>(vi)\tIn<br \/>\nview of the fact that entire transaction has been set at naught by<br \/>\ncancelling sale deed and now possession of first informant is free<br \/>\nfrom all encumbrances, applicant accused can be released on bail<br \/>\nsubject to certain terms and conditions.\n<\/p>\n<p>5.\t\tIn<br \/>\nthis view of the matter, accused-applicant is ordered to be enlarged<br \/>\non regular bail in connection with offence registered with Bopal<br \/>\nPolice Station, Ahmedabad (Rural) being C.R.No.I-35 of 2011 on<br \/>\nexecuting a bond in the sum of Rs.15,000\/- (Rupees fifteen thousand<br \/>\nonly) with one surety of the like amount to the satisfaction of the<br \/>\nlower Court and subject to the conditions that he shall :\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\nSessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tmark presence at the concerned police station once in a month<br \/>\nbetween 10.00 a.m. and 3.00 p.m.;\n<\/p>\n<p>f)<br \/>\n\tfurnish  present address of his residence to the I.O. and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nthe residence without prior permission of this Court;\n<\/p>\n<p>g)\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>6.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>7.\t\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>8.\t\tIt<br \/>\ngoes without saying that any observations touching the merits of the<br \/>\ncase are purely for the purpose of deciding<br \/>\n the question of grant of bail and shall not be construed as<br \/>\nan expression of the final opinion in the main matter.\n<\/p>\n<p>9.\t\tRule<br \/>\nis made absolute to the aforesaid extent.
