Appeal No.80\/2011 by<\/p>\n<p>                     which the order dated 19.07.2011 passed by the learned<\/p>\n<p>                     Juvenile Justice Board, Begusarai in Begusarai Town P.S.<\/p>\n<p>                     Case No.355 of 2010 under Section 379 of the I.P.C. has<\/p>\n<p>                     been confirmed and the prayer of the petitioner for grant of<\/p>\n<p>                     bail has been rejected.\n<\/p>\n<p>                                 Heard Mr. Akhileshwar Prasad Singh, the<\/p>\n<p>                     learned senior counsel for the petitioner and Mrs.<\/p>\n<p>                     I.B.Pandey, learned counsel for the State.<\/p>\n<p>                                 The main contention of the learned counsel for<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>the petitioner is that the petitioner has been declared a<\/p>\n<p>juvenile by the learned Juvenile Justice Board vide order<\/p>\n<p>dated 13.07.2011. His prayer for bail was rejected by the<\/p>\n<p>Juvenile Justice Board vide order dated 19.07.2011.<\/p>\n<p>Against the said order, the petitioner preferred Cr. Appeal<\/p>\n<p>No.80\/11, which has been dismissed by the impugned<\/p>\n<p>order. It is submitted that the petitioner has been remanded<\/p>\n<p>in this case on 13.07.2011. He has further submitted that a<\/p>\n<p>report has been called for from the Probation Officer,<\/p>\n<p>Begusarai through the Juvenile Justice Board, Begusarai,<\/p>\n<p>which has been received vide letter no.89 dated<\/p>\n<p>28.09.2011. It shows that the petitioner has become addict<\/p>\n<p>of intoxication and his father will get him treated so that<\/p>\n<p>the petitioner could get relief from intoxication. He has<\/p>\n<p>further submitted that the family of the petitioner has no<\/p>\n<p>criminal antecedent. In the report, it has also been<\/p>\n<p>recommended that an opportunity should be given to the<\/p>\n<p>petitioner for his treatment.\n<\/p>\n<p>            Learned counsel for the State could not<\/p>\n<p>controvert the contention of the petitioner while opposing<\/p>\n<p>the prayer of the petitioner.\n<\/p>\n<p>            After hearing the learned counsel for both the<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>parties and on perusal of the materials on record as well as<\/p>\n<p>report, it appears that the contention of the learned counsel<\/p>\n<p>for the petitioner is correct. The petitioner has been in<\/p>\n<p>custody since 28.09.2010 and has been remanded in this<\/p>\n<p>case on 13.07.2011.\n<\/p>\n<p>            Considering the facts and circumstances stated<\/p>\n<p>above, in my opinion, the impugned order is not fit to be<\/p>\n<p>sustained. The impugned order is set aside. The petitioner<\/p>\n<p>above-named is directed to be released on bail on<\/p>\n<p>furnishing bail bond of Rs.10,000\/-with two sureties of the<\/p>\n<p>like amount each to the satisfaction of learned Juvenile<\/p>\n<p>Justice Board, Begusarai in Begusarai Town P.S. Case<\/p>\n<p>No.355 of 2010 on the following terms and conditions :<\/p>\n<p>            (i)            Father and Mother of the<\/p>\n<p>                           petitioner will be the bailors.\n<\/p>\n<p>            (ii)           They will produce the petitioner<\/p>\n<p>                           in the court if and when<\/p>\n<p>                           required.\n<\/p>\n<p>            (iii)          The petitioner will not indulge<\/p>\n<p>                           in similar or in any other<\/p>\n<p>                           offence.\n<\/p>\n<p>            (iv)           In case of his absence for two<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>                                          consecutive dates or in case of<\/p>\n<p>                                          violation of the terms of the<\/p>\n<p>                                          bail, his bail bond will be liable<\/p>\n<p>                                          to be cancelled by the learned<\/p>\n<p>                                          Juvenile Justice Board and he<\/p>\n<p>                                          will be taken into custody.\n<\/p>\n<p>                    In the result, this application is allowed.<\/p>\n<p>                    Let this order be communicated to the court below<\/p>\n<p>              through fax at the cost of the petitioner.<\/p>\n<pre>V.K.
