Justice M.RAMACHANDRAN\n\n Dated :23\/01\/2007\n\n O R D E R\n                  V.K.Bali,C.J. &amp; M.Ramachandran,J.\n\n                 --------------------------------------------\n\n                        W.P.(C).No.1309 of 2007-S\n\n                 ---------------------------------------------\n\n                Dated, this the 23rd day of January, 2007\n\n\n                                 JUDGMENT\n<\/pre>\n<p>V.K.Bali,C.J.\n<\/p>\n<\/p>\n<p>              Ram Mohan, who states himself to be a public spirited<\/p>\n<p>person   and   social   activist   associated   with   various   service<\/p>\n<p>organisations, has filed this writ petition under Article 226 of the<\/p>\n<p>Constitution  of  India  by  way  of  public   interest   litigation  seeking<\/p>\n<p>the following reliefs:\n<\/p>\n<\/p>\n<blockquote><p>      &#8220;(i)     a   Writ   of   Mandamus   or   any   other   appropriate<\/p>\n<p>      writ,   order   or   direction   commanding   the   respondents<\/p>\n<p>      to   implement   the   statutory   provisions   contained   in<\/p>\n<p>      Rule 16(2) and Rule 48 of the Central Motor Vehicles<\/p>\n<p>      Rules, 1989 by issuing Driving Licenses and Certificate<\/p>\n<p>      of Registration of Vehicles in Smart Cards and Smart<\/p>\n<p>      Optical   Cards   as   set   out   in   Ext.P3   Government<\/p>\n<p>      Notification;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>      (ii)     a   Writ   of   Mandamus   or   any   other   appropriate<\/p>\n<p>      writ,   order   or   direction   commanding   the   2nd<\/p>\n<p>      respondent   to   notify   the   implementation   of   Smart<\/p>\n<p>      Card and Smart Optical Card project at various offices<\/p>\n<p>      of   the   Motor   Vehicles   Department   in   the   State   with<\/p>\n<p>      immediate effect with consequential orders thereto;<\/p><\/blockquote>\n<pre>\n\n\n      (iii)    a   Writ   of   Mandamus   or   any   other   appropriate\n\n\nWP(C).1309 of 2007                    - 2 -\n\n\n\n\n\n<\/pre>\n<blockquote><p>      writ,   order   or   direction   commanding   the   respondents<\/p>\n<p>      to take all  necessary steps for  the implementation  of<\/p>\n<p>      the   project   for   the   issuance   of   Driving   Licence   and<\/p>\n<p>      Certificate   of   Registration   in   Smart   Card   and   Smart<\/p>\n<p>      Optical Card Format with immediate effect;<\/p>\n<\/blockquote>\n<blockquote><p>      (iv)    any other or further order as this Hon&#8217;ble Court<\/p>\n<p>      may   deem   fit   and   proper   on   the   facts   and   in   the<\/p>\n<p>      circumstances of the case&#8221;.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>The reliefs reproduced above are sought to rest on the pleadings<\/p>\n<p>that   the   general   public   of   the   State   is     exploited   by   the<\/p>\n<p>touts\/middlemen   operating   in   various   Regional   Transport\/Sub<\/p>\n<p>Transport   Offices   in   the   State   who   maintain   an   unholy   alliance<\/p>\n<p>with   certain   corrupt   officials   of   the   department   for   providing<\/p>\n<p>various   services   in  connection  with  issuance  of   Driving   Licences<\/p>\n<p>and Certificate of Registration of vehicles. Even though majority<\/p>\n<p>of   the   States   in   India   have   switched   over   to   the   electronic<\/p>\n<p>medium   of   Smart   Card   format   for   issuance   of   the   above<\/p>\n<p>certificates,   Kerala   State   did   not   take   any   positive   steps   to<\/p>\n<p>implement   the   statutory   provisions   contained   in   the   Central<\/p>\n<p>Motor Vehicles Rules and has miserably failed to discharge their<\/p>\n<p>statutory powers which are coupled with statutory duties for the<\/p>\n<p>benefit of general public. The official apathy and indifference on<\/p>\n<p>WP(C).1309 of 2007                       &#8211; 3 &#8211;\n<\/p>\n<p>the   part   of   the   respondents   have   caused   denial   of   justice   and<\/p>\n<p>negation of fundamental rights guaranteed to the  citizens under<\/p>\n<p>the Constitution of India.\n<\/p>\n<\/p>\n<p>              2. The Court finds from the records of the case that for<\/p>\n<p>the   reliefs   aforesaid,   prior   in   point   of   time   the   petitioner   made<\/p>\n<p>representation   dated   16th  December,   2006   before   the   Chief<\/p>\n<p>Minister of Kerala, Thiruvananthapuram and during the course of<\/p>\n<p>argument, it is revealed that the same has not been attended or<\/p>\n<p>responded   yet.   The   Court   further   finds   from   the   records   of   the<\/p>\n<p>case   that   pursuant   to   notification   issued   by   the   Central<\/p>\n<p>Government in the year 2002 for the issuance of Smart Card and<\/p>\n<p>Smart Optical Card, Government of Kerala initiated steps in this<\/p>\n<p>regard in the year 2006. Photo copy of the notification issued by<\/p>\n<p>the   Government   of   Kerala   dated   19th  June,   2006   has   been<\/p>\n<p>annexed   with   the   petition   as   Exhibit   P3.   It   is   the   case   of   the<\/p>\n<p>petitioner that the Government had initiated steps for the award<\/p>\n<p>of   contract   to   implement   the   above   project   in   February,   2006.<\/p>\n<p>Tenders were invited from qualified bidders for the award of the<\/p>\n<p>contract and upon the completion of the procedures, the contract<\/p>\n<p>had been   awarded in March, 2006 to a public sector company,<\/p>\n<p>WP(C).1309 of 2007                     &#8211; 4 &#8211;\n<\/p>\n<p>but even after the award of contract, no positive steps have been<\/p>\n<p>taken   by   the   Government   to   implement   the   scheme   in   various<\/p>\n<p>Regional Transport Offices of the State.\n<\/p>\n<\/p>\n<p>             3. The representation, Exhibit P5 dated 16th December,<\/p>\n<p>2006, has not been attended or responded to yet. Meanwhile, as<\/p>\n<p>mentioned above, notification Exhibit P3 has already been issued<\/p>\n<p>by the Government pursuant to the notification earlier issued by<\/p>\n<p>the Central Government. In these circumstances, the counsel for<\/p>\n<p>the   petitioner   states   that   the   Court   may   direct   the   concerned<\/p>\n<p>respondents to deal with Exhibit P5 representation and decide the<\/p>\n<p>same as expeditiously as possible.\n<\/p>\n<\/p>\n<p>             4. Even though when the matter came up for hearing<\/p>\n<p>before us on 11.1.2007 we were inclined to issue directions so as<\/p>\n<p>to at least consider the representation Exhibit P5, but the learned<\/p>\n<p>Government   Pleader   sought   an   adjournment.   Today   again   he<\/p>\n<p>seeks   an   adjournment.   In   view   of   the   order   we   are   inclined   to<\/p>\n<p>pass,   we   are   of   the   view   that   no   further   adjournment   be<\/p>\n<p>necessitated.\n<\/p>\n<\/p>\n<p>             5. Without going into the merits of the case, we only<\/p>\n<p>direct   that   the   representation,   Exhibit   P5,   be   disposed   of   as<\/p>\n<p>WP(C).1309 of 2007                   &#8211; 5 &#8211;\n<\/p>\n<p>expeditiously   as   possible   and   preferably   within   six   weeks   from<\/p>\n<p>today. If the representation, Exhibit P5, may not have to be dealt<\/p>\n<p>with by the Chief Minister himself in exercise of his powers, the<\/p>\n<p>same   shall   be   referred   to   the   competent   authority   vested   with<\/p>\n<p>powers and dispose of the same in accordance with law.<\/p>\n<p>            The   writ   petition   is   disposed   of   with   the   limited<\/p>\n<p>direction as mentioned above.
