A. No. 1986 of 2011 through which<\/p>\n<p>                 the appellant claims himself to be a juvenile.<\/p>\n<p>                           Learned counsel for the appellant submitted<\/p>\n<p>                 that the appellant was juvenile on the date of<\/p>\n<p>                 occurrence i.e. 7.6.1994 because his date of birth is<\/p>\n<p>                 3rd   May,     1977    which     is    apparent    from   the<\/p>\n<p>                 Matriculation certificate issued by the Bihar School<\/p>\n<p>                 Examination Board.\n<\/p>\n<p>                           The occurrence is of 7.6.1994 and the<\/p>\n<p>                 matriculation      certificate   has   come   in   existence<\/p>\n<p>                 thereafter.\n<\/p>\n<p>                           Learned APP has drawn attention of this<\/p>\n<p>                 Court towards the own narration of the appellant<\/p>\n<p>                 regarding his age before the trial court when his<\/p>\n<p>                 statement under section 313 Cr.P.C. was recorded on<\/p>\n<p>                 10.7.2003 and on that date he himself claimed his age<\/p>\n<p>                 to be 29 years.\n<\/p>\n<p>                               These contrasts need to be verified by the<\/p>\n<p>                 Juvenile Justice Board, Lakhisarai.<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>                  Considering the aforesaid submissions, we<\/p>\n<p>       direct the Juvenile Justice Board, Lakhisarai to hold<\/p>\n<p>       an inquiry as to whether the appellant Rakesh Yadav-<\/p>\n<p>       a convict of Sessions Trial No.212 of 1996 relating to<\/p>\n<p>       G. R. No. 475 1994, convicted by the learned<\/p>\n<p>       Additional Sessions Judge, F.T.C. No. IVth, Lakhisarai<\/p>\n<p>       on 31.5.2011 was juvenile on the date of occurrence<\/p>\n<p>       or not.
