Vyas, learned advocate waivers the service of notice of rule<br \/>\n\ton behalf of the contesting respondent Nos.1 to 4 and 6 to 8.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocates appearing on behalf of the<br \/>\n\trespective parties, present application is taken up for final<br \/>\n\thearing today.\n<\/p>\n<p>Present<br \/>\n\tapplication has been preferred by the applicants -original<br \/>\n\tdefendants permitting them to bring the heir and representative of<br \/>\n\tthe respondent No.5   deceased Bhatt Bhupendrabhai Bhagwatiprasad<br \/>\n\ton the record of Civil<br \/>\n\tApplication No. 8110 of 2009 as well as Second<br \/>\n\tAppeal  (Stamp) No.194 of 2009.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates appearing on behalf of the respective<br \/>\n\tparties  and the application is not seriously opposed by Mr.Vyas,<br \/>\n\tlearned advocate appearing on behalf of the proposed heir and legal<br \/>\n\trepresentative  of the respondent No.5, the application is allowed<br \/>\n\tand the applicants are permitted to bring  the heir of respondent<br \/>\n\tNo.5   deceased Bhatt  Bhupendrabhai Bhagwatiprasad on the record<br \/>\n\tof the Civil<br \/>\n\tApplication No. 8110 of 2009 and Second<br \/>\n\tAppeal  (Stamp) No.194 of 2009, as mentioned in the cause<br \/>\n\ttitle of the present application, as respondent No.5\/1. Registry to<br \/>\n\tamend the cause title of the   Civil<br \/>\n\tApplication No. 8110 of 2009 and Second<br \/>\n\tAppeal  (Stamp) No.194 of 2009 accordingly.
