No.2670 of 2009\n            ------------------------------------------\n        Dated this the 26th   day of November, 2009\n\n                         JUDGMENT\n<\/pre>\n<p>S.R.Bannurmath, C.J.\n<\/p>\n<p>           Aggrieved by the rejection of the tender of the<\/p>\n<p>appellant disqualifying him for not giving the complete<\/p>\n<p>information as required, he had approached the learned<\/p>\n<p>Single Judge in W.P.(C) No.30728 of 2009 and on<\/p>\n<p>considering the rival contentions, the learned Judge<\/p>\n<p>found that the appellant had failed to produce the<\/p>\n<p>complete necessary materials, especially the profit and<\/p>\n<p>loss statements, balance sheets and auditor&#8217;s report as<\/p>\n<p>required under clause 9.14(g)of the tender conditions.<\/p>\n<p>           2.   The appellant undisputedly had submitted<\/p>\n<p>the profit and loss statements and balance sheets for only<\/p>\n<p>three years and as such rightly the tendering authority as<\/p>\n<p>well as the learned Single Judge, in our view, was<\/p>\n<p>justified in rejecting the challenge of the appellant against<\/p>\n<p>disqualification as the requirement was specifically made<\/p>\n<p>W.A.No.2670 of 2009\n<\/p>\n<p>                             &#8211; 2 &#8211;\n<\/p>\n<p>for five years. Moreover, as is brought to our notice by the<\/p>\n<p>learned Government Pleader, the tender process has been<\/p>\n<p>completed and the work has already started on 1.11.2009<\/p>\n<p>completing the basic requirements like leveling,       earth<\/p>\n<p>work, widening and improvements and supply of metals for<\/p>\n<p>road work.\n<\/p>\n<p>            3. Considering all these aspects, in our view,<\/p>\n<p>there is absolutely no merit in the present case.   The writ<\/p>\n<p>appeal is accordingly rejected.      However, if the tender<\/p>\n<p>conditions provide for refund of cost of tender documents,<\/p>\n<p>the appellant may approach the concerned authority and if<\/p>\n<p>permissible under the tender conditions, the authority can<\/p>\n<p>consider refund of the entire or part of the said amount.<\/p>\n<p>                                  S.R.Bannurmath,<br \/>\n                                   Chief Justice<\/p>\n<p>                                   A.K.
