Justice K.T.SANKARAN\n\n Dated :09\/11\/2006\n\n O R D E R\n                 (M.RAMACHANDRAN &amp; K.T.SANKARAN,  JJ)\n\n        -------------------------------------------------------------\n\n\n                        F.A.O.No.262  of 2006\n\n\n        --------------------------------------------------------------\n\n             Dated this the 9th day of November, 2006\n\n\n                               JUDGMENT\n<\/pre>\n<p>Sankaran, J:\n<\/p>\n<p>       This   appeal   is   filed         against   the   order   dated<\/p>\n<p>25-08-2006   refusing   leave   to   file   the   suit   as   an   indigent<\/p>\n<p>person.       The   appellant\/plaintiff   instituted   the   suit   against<\/p>\n<p>his father for realisation of money.       The court fee payable<\/p>\n<p>in the suit is Rs.29, 750\/-.  The contention of the appellant is<\/p>\n<p>that   he   has   no   property   or   income   except   the   properties<\/p>\n<p>shown in the schedule to the application for leave to file the<\/p>\n<p>suit as an indigent person.   Item No.1  in the C schedule is<\/p>\n<p>his residential  property and item No.2 of   C schedule is the<\/p>\n<p>property   assigned   to   the   appellant   by   his   father.     The   B<\/p>\n<p>schedule   properties   are   the   movables   belonging   to   the<\/p>\n<p>appellant.  He contended that except those mentioned in  B<\/p>\n<p>and   C   schedule,   he   has   no   other   properties,   assets   or<\/p>\n<p>income.\n<\/p>\n<p>       2.     The respondent contended that the appellant is a<\/p>\n<p>person     having   sufficient   means   to   pay   the   court   fee.     A<\/p>\n<p><span class=\"hidden_text\">[FAO No.262 of 2006]                 -2-<\/span><\/p>\n<p>commission was taken out to disprove the contentions raised<\/p>\n<p>by the appellant.  The Commissioner filed Ext.C1 report.  The<\/p>\n<p>report   of   the   Commissioner   shows   that   the   house   of   the<\/p>\n<p>appellant is having an area of 1200 Sq.feet.  There is a cattle<\/p>\n<p>shed,   in   which   7   cattle   could   be   accommodated.         The<\/p>\n<p>Commissioner   had   seen   4   cows   in   the   cattle   shed.     The<\/p>\n<p>Commissioner  has  also reported  that  in  the  house belonging<\/p>\n<p>to   the   appellant   he   saw   a   Television   set,   Tape   recorder,<\/p>\n<p>Sewing Machine, V.C.D, Fridge, Heater, Fan etc.   There is a<\/p>\n<p>motor  shed  in  the  properties  belonging   to  the  appellant   and<\/p>\n<p>there is electric connection as well.\n<\/p>\n<p>       3.    The   court   below   disbelieved   the   evidence   of   the<\/p>\n<p>appellant as PW1, and held that no attempt was made by the<\/p>\n<p>appellant to   assail the Comissioner&#8217;s report and to set aside<\/p>\n<p>the same.  A contention was raised that the Commissioner had<\/p>\n<p>inspected   some   other   property   and   not   the   property<\/p>\n<p>belonging   to   the   appellant.     This   belated   contention   was<\/p>\n<p>negatived  by   the   court   below.    The   house   was  shown  to  the<\/p>\n<p>Commissioner   by   the   father   of   the   appellant.         The   court<\/p>\n<p>below   has   noticed   that   if   the   property   inspected   by   the<\/p>\n<p><span class=\"hidden_text\">[FAO No.262 of 2006]                   -3-<\/span><\/p>\n<p>Commissioner is not owned by the appellant,   an application<\/p>\n<p>could   be   filed by the  appellant directing the Commissioner<\/p>\n<p>to   visit   the   correct   place,   but   that   was   not   done   by   the<\/p>\n<p>appellant.       The   appellant   admitted   in   evidence   that   the<\/p>\n<p>movables   found   by   the   Commissioner   are   kept   in   his   own<\/p>\n<p>house.   The Court below concluded that the evidence of PW1,<\/p>\n<p>when  considered along with Ext.C1 report, would prove  that<\/p>\n<p>the appellant has sufficient means to pay the court fee.\n<\/p>\n<p>       4.     The   learned   counsel   for   the   appellant   had   also<\/p>\n<p>raised   a   contention   that   the   properties   mentioned   in   the<\/p>\n<p>schedule   to   the   application   filed   for   permission   to   file   the<\/p>\n<p>present   suit   as   an   indigent   person   is   the   subject   matter   of<\/p>\n<p>O.S.No.2138   of   2004   on   the   file   of   the   Munsiff&#8217;s   Court,<\/p>\n<p>Irinjalakuda,   filed   against   the   appellant   by   his   father.     The<\/p>\n<p>contention  is that under  Order XXXIII  Rule  1  of the  Code  of<\/p>\n<p>Civil Procedure, for the purpose of assessing the means of the<\/p>\n<p>plaintiff   to   pay   the   court   fee,     the   subject   matter   of<\/p>\n<p>O.S.No.2138   of   2004   is   to   be   excluded.     Counsel   relies   on<\/p>\n<p>Explanation 1 to Rule 1 of Order XXXIII, which provides that a<\/p>\n<p>person   is   an   indigent   person,   if   he   is   not   possessed   of<\/p>\n<p><span class=\"hidden_text\">[FAO No.262 of 2006]                     -4-<\/span><\/p>\n<p>sufficient   means   (other   than   property   exempt   from<\/p>\n<p>attachment in execution of a decree and the subject matter of<\/p>\n<p>the   suit)   to   enable   him   to   pay   the   fee   prescribed   by   law   for<\/p>\n<p>the   plaint   in   such   suit.     Laying   emphasis   on   the   words   &#8216;the<\/p>\n<p>subject matter of the suit&#8217;   the counsel contends that even if<\/p>\n<p>the property is the subject matter of another suit, the value of<\/p>\n<p>that property cannot be taken into account for assessing the<\/p>\n<p>means of the plaintiff.   The words employed in Explanation 1<\/p>\n<p>to Rule 1 of Order XXXIII are &#8220;the subject matter of the suit&#8221;\n<\/p>\n<p>and   not   subject   matter   of   &#8220;a   suit&#8221;   or   &#8220;any   suit&#8221;.     The   only<\/p>\n<p>irresistible   conclusion   that   could   be   arrived   at   is   that   the<\/p>\n<p>value   of   a   property   could   be   excluded   from   the   purview   of<\/p>\n<p>assessment of the means of the plaintiff only if the property is<\/p>\n<p>the subject matter of that suit itself.   Even  if the property is<\/p>\n<p>the   subject   matter   of   another   suit,   that   is   not   a   ground   to<\/p>\n<p>exclude   it   from   the   purview   of   Rule   1   of  Order   XXXIII   or   to<\/p>\n<p>exclude   it   from   valuation   so   as   to   assess   the   indigency   or<\/p>\n<p>otherwise   of   the   plaintiff.       Only   when   the   property   in<\/p>\n<p>question   is   the   subject   matter   of   the   same   suit   filed   by   the<\/p>\n<p>indigent person, such property could be excluded as provided<\/p>\n<p><span class=\"hidden_text\">[FAO No.262 of 2006]                           -5-<\/span><\/p>\n<p>in Explanation 1 to Rule 1 of Order XXXIII of the Code of Civil<\/p>\n<p>Procedure.\n<\/p>\n<p>        5.      The contentions raised by the appellant are devoid<\/p>\n<p>of merit.  The appeal is accordingly dismissed.\n<\/p>\n<p>        6.
