No.WI7i.n\nNo. 1\/2004 on the \ufb01le of the District Judge, Haveri.    ..\n\nThis appeal coming on for \ufb01nal hearing this   \n\ndelivered the following:\n\nJUDGMENT.'\n\n1. The instant appeal arising out ordeli  is\n\nin M.C. No. 1\/2004 on the file of  Judge,.._I71at5'eri, dated\n\n17.12.2004.\n\n2. The only    iicounsel appearing for\nappeliant at the   Judge has committed\nan error in di\u00b0s.;nissiingi'the:-filed by the petitioner regarding\nmaintainabilityiof..i_appiiciat'ici;1v141 Rule 5 r\/W Sec. :51 of CPC.\nThe said iifil'edv...b.y\u00ab'the appellant herein had come up for\n\ncoris.iderati--o1_i the learned District Judge on 17.12.2004.\n\n after hearing both the sides dismissed the\n\n\u00ab -.i.i.i'_application \ufb01'1ed1- by the appellant herein. Be that as it may, the said\n\nii'v..4ii'-ciaseihad .coi:'ne up for consideration before this Court on 27.01.2005\n\nCourt dismissed the appeai at the admission stage. Thereafter\n\n%\/\n\n\n\nthe petitioner has \ufb01led a Review Petition No. 338\/05 in M.F.A. No.\n\n506\/05. The said matter had come up for consideration befo1\"e this\n\nCourt on 12.08.2005. This Court after hearing both \n\nthe Review Petition and set aside the order dated.\u00ab-2e.7}QVVIi.:2Q0.S. .. \n\napparent mistake has been crept in the order  ,vievvffo_f \n\nNoti\ufb01cation issued in the month 5_f'\u00ab-Noveinber'  iiviherein \n\nRegistry of this Court has envisaged po_vv'er_of the .Distr,ictVJii1dge to be\nexercised under the Special lV\u00a7arri.age vvvith the Court of\nCivil Iudges. The rnaLfter__wa;s'iire'st'orcd\"t;ore__consideration on merits.\nHaving regard  re'l\u00b0_erredV.above the instant appeal\nis \ufb01led beingeaggrievedibyitlieliirtpugned order passed on LA. No. 1 in\n\nM.C. No I\/2004l\"onlthe learned District Jude, Haveri.\n\n    heard thelmlearned counsel appearing for appellant.\n\nLearned\"'iooun'se'l_~,fori.i':;appellant at the outset submitted that, the order\n\n irnpugned\"\"pas--sed\"oin LA. No. i, is apparent on the face of the order.\n\n.1 -Learinedii District Judge has committed an error in dismissing the\n\niii'\"Cf-..appl'iclatiorii \ufb01led by the petitioner u\/O vii Rule 10 CPC. re\n\n%\/\n\n\n\nsubstantiate his submission he placed reliance on the Noti\ufb01cation\n\nissued by the Registry of High Court of Karnataka, Bangalore,____in the\n\nmonth of November 1978 contending that power has been ftpiothe\n\njurisdictional Civil Eudge Courts now it is called as   \n\nDn.) Court in respect to the Civil Judg'e\"m(S'r'.\u00ab \n\nTherefore he submitted that the impugned order'passedglbylptlie  \n\nDistrict Judge is liable to be set aside.  \n4. As against this, learned for respondent to<\/pre>\n
substantiate the impugned order’_passedl__lby the.V.lear_r_1ed District Judge<\/p>\n
contended that; lieam\u00e9fa  ilnuclonsonance with the relevant
\nprovisions of ‘Hindu  passed the order impugned.<\/p>\n
Therefore interference byrtitisilfiourt does not call for.<\/p>\n

C   passed on 12.08.2005. It is manifest on the face ofthe order<\/p>\n
llthat:.fh_i_sl Court has set aside the order passed earlier dated 27.01.2005<\/p>\n

dismissing the appeal filed by the petitioner. Thereafter the appellant<\/p>\n
has filed a Review Petition. The Review Petition was allowed,ar1.dthVe<\/p>\n

 ‘Reg,istiar. Therefore we are of the considered view the impugned<\/p>\n

order passed on I\/A. No. I in M.C. No. 1\/2004 on the file of District<\/p>\n
Judge, Haveri, cannot be sustainable. Hence it is set aside.<\/p>\n
7. For the aforesaid reasons the appeal is allowed ifriipart.<\/p>\n
