An award dated 2.4.2004 in K.I.D.No.646\/2000 is ca]1ed’–i_n<\/p>\n
question.\n<\/p>\n
2. The respondent is a Conductor. He was cha1}3’*e\u00a5siieete?1 –  it<\/p>\n
for re-issue of tickets of denomination of RSQQG\/.-A_
\npassengers, who were travelling front
\nand reissue of 3 tickets of   \u00a33
\npassengers, who were trave1Hng..iiom\u00abVAB;:in\u00a7g_.a1o;*ve t0.i’ii\ufb02d11p’i:1I’ and
\nfailed to get endorsement  ‘in this regasd.\n<\/p>\n
an enquixy was heldi     a report,\nholding that the    Authority\n<\/pre>\n
on the basis of the   Enqtiixy Omcer issued Show
\ncause notice    order of dismissal.\n<\/p>\n
 , K3.  a dispute befom the Labour<\/p>\n
 ;i’The   held that the enquixy is fair and<\/p>\n
 e,_pvroper”. ‘-  pexveraity of \ufb01nding, the Labour Court<\/p>\n
iiielied on \u00bb\u00a7%a.vj Em mar”  ked as Ex.MS and found that the entries do<\/p>\n
__thei”pi1fe1age of the Corporation revenue, but it only<\/p>\n
 negligence on the part of the respondent in making the<\/p>\n
  V  r _ eIit;iie’s”i3.nd further found that the dismissal order is harsh and<\/p>\n
 the punishment to that of denial of three increments<\/p>\n
iivithout backwages.\n<\/p>\n

4. Learned Counsel appearing for the petitioner submitred
\nthat. the respondent had started from Raichur to <\/p>\n
in respect of tickets of 123.20\/– denomination. he    .<\/p>\n
starting entry as 445215 and thereaften when”‘i1e.: ll  <\/p>\n
Bangalore, he started the entry for tickers
\nRs.20\/- with 445224. Relying on7th_ese  V
\nCounsel submitted that the tickets bessn -145\u00e91~se%\u00a7pl44s224, 9
\ntickets, which were sold    to
\nBangalore, were reissued by  passengers
\ntravelling from  do =  lBanga1ore to
\nGowribidanur     bill. She further
\nsubmitted  to get the entry
\nclosed by the Bangalore, but he has got it
\ndone by ”   on Ex.M5, learned Counsel
\n\u00bb:th’e_c:harg:e'”‘isproved and the enquiry is held as<\/p>\n
fairlland   is so, in case of pilferage, the Labour<\/p>\n

.4 H   ; Counsel for the Iespondent submitted that,<\/p>\n
  is ‘no; pilferage found against the respondent She also<\/p>\n
  _  Ex.M5 and pointed out that, against the tickets of<\/p>\n
 .Avde’I\u00a3<lJmi11ation of 125.20] ~ \ufb01mn Raichur to Bangalore, the starting<\/p>\n
'entry is 445215 and there is no ticket sold from the said<\/p>\n
denomination and thereafter by mistake. the respondent instead<\/p>\n
we<\/p>\n

of commencing the entry as 445215. he started as 445224. She<\/p>\n
submitted that, even if the mistake is committed by <\/p>\n
respondent in making the entry, he is requixed <\/p>\n
amount for the corresponding tickets as in between’-\u00abt?   it<\/p>\n
which were not mentioned, are requi1ed.”to  &_c’ounted5  the <\/p>\n
respondent himself and it cannot be   is <\/p>\n

6. The  respondent is that. reissue
\nof \ufb01ckete of  of Rs.20\/~. From the perusal of<\/p>\n
  ‘entry in the way bill is 445215, which staxts<\/p>\n
 u from  of 20 rupees tickets and there is no sale
\n tickets@’tom:  till Bangaloxe. It is not pointed out that,
\n ticlgeteiwizere sold and the amount was credited by the<\/p>\n
  and thereafter, again he has sold the same tickets.<\/p>\n
 –aippears \ufb01om Ex.MS is that, the respondent, who was
\n  to commence the entry from Bangalore as 445215, has<\/p>\n
Hicommeneed the entry as 445224 by omitting mentioning of 9<\/p>\n
7\\\u00bb-\n<\/p>\n
   and also by denying backwages.\n<\/p>\n

number, the respondent will not be bene\ufb01ted or will not <\/p>\n
any gain nor will’ it cause loss to the Corporation revenue as  d ‘<\/p>\n
respondent, who was in possession of the tickets.’   <\/p>\n
Rs.20]– denomination, which are sold  <\/p>\n
bill, are required to be credited to theiaccount
\nIf he had sold the tickets in the 3 fm}m\u00ab 1  to
\nBangalore and thereafter he  certainly it
\nattracts the allegation of\u00bb the way bill
\nat Ex.M5 do not  sold the tickets<\/p>\n
commencing from   “if  are not sold and if<\/p>\n
there is an erfzor’–in   in particular cohnnn, it
\ncannot be held that the  has committed a misconduct
\nof piiferage  Corxporationvrevenue. As far as second charge<\/p>\n
is concerned, the ‘I’ra;E\ufb01c Controller has not made the<\/p>\n
 entxy,  any prejudice to the Corporation
\n it attractsv-._’an3*’T”‘major punishment The negligence on the
\nd   therespondent is proved by the evidence and for that, the<\/p>\n
 has punished the xespondent by denying 3<\/p>\n
in such<\/p>\n
 “-\u00abciit:”i1n1stances, when the case of pilferagc is not proved by the<\/p>\n
Corporation based on its own document, I find that the<\/p>\n
punishment of dismissal is harsh and the Labour Court in<\/p>\n

exercise of its discretionary power under Section 11–A of the<\/p>\n
Industrial Disputes Act has rightly modified the punishment <\/p>\n
my opinion, it does not call for interference by this Court.  ”   ” <\/p>\n
