No.24468 of 2011\n                                Chanchal Kumar son of Nathuni Sah\n                                                Versus\n                                        The State Of Bihar\n                                              -----------\n<\/pre>\n<p>4.   18.10.2011                Heard learned Counsel for the petitioners and the<\/p>\n<p>                  State.\n<\/p>\n<p>                              The petitioners seek bail in a case instituted for the<\/p>\n<p>                  offence under Section 394 of the Indian Penal Code.<\/p>\n<p>                              Considering that the petitioners have been named<\/p>\n<p>                  in the confessional statement of the co-accused but there has<\/p>\n<p>                  been no recovery from their possession and they have fair<\/p>\n<p>                  antecedents, let the petitioners above named, be released on<\/p>\n<p>                  bail on furnishing bail bond of Rs. 5,000\/-(Five thousand) with<\/p>\n<p>                  two sureties of the like amount each or any other surety to be<\/p>\n<p>                  fixed by the court concerned to the satisfaction of learned<\/p>\n<p>                  Chief Judicial Magistrate, East Champaran at Motihari in<\/p>\n<p>                  connection with Govindganj (Areraj) P.S. Case No.47 of 2011,<\/p>\n<p>                  subject to the conditions (i) That one of the bailor shall be the<\/p>\n<p>                  father\/brother of the petitioners and the other bailor will be a<\/p>\n<p>                  close relative of the petitioners who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioners. The<\/p>\n<p>                  bailor will undertake to furnish information to the Court about<\/p>\n<p>                  any change in address of the petitioners. (ii) That the affidavit<br \/>\n<span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>shall clearly state that the petitioners are not an accused in<\/p>\n<p>any other case and if they are they shall not be released on<\/p>\n<p>bail, (iii) That the bailor shall also state on affidavit that he will<\/p>\n<p>inform the court concerned if the petitioners are implicated in<\/p>\n<p>any other case of similar nature after their release in the<\/p>\n<p>present case and thereafter the court below will be at liberty<\/p>\n<p>to initiate the proceeding for cancellation of bail on ground of<\/p>\n<p>misuse, (iv) That the petitioners will give an undertaking that<\/p>\n<p>they will receive the police papers on the given date and be<\/p>\n<p>present on date fixed for charge and if they fail to do so on<\/p>\n<p>two given dates and delays the trial in any manner, their bail<\/p>\n<p>will be liable to be cancelled for reasons of misuse, (v) That<\/p>\n<p>the petitioners will be well represented on each date if they<\/p>\n<p>fail to do so on two consecutive dates, their bail will be liable<\/p>\n<p>to be cancelled.\n<\/p>\n<p>         Learned Counsel for the petitioners submits that the<\/p>\n<p>petitioners have been implicated at the instance of the local<\/p>\n<p>police who is hostile to the petitioners and seek protection of<\/p>\n<p>a person well reputed doing social service in the area. Under<\/p>\n<p>the circumstances, the petitioners are directed to appear<\/p>\n<p>before the Head Priest of local Temple, Motihari within fifteen<\/p>\n<p>days of their release and file a certificate about the same in<\/p>\n<p>the Court. On filing of the certificate the petitioners will be<\/p>\n<p>granted provisional bail for a period of six months. In case,<\/p>\n<p>the petitioners do not file a certificate about their reporting to<br \/>\n<span class=\"hidden_text\">                                    -3-<\/span><\/p>\n<p>            the Head Priest within two weeks of their release from jail<\/p>\n<p>            custody, they shall be noticed for cancellation of bail. During<\/p>\n<p>            six months the petitioners are expected to engage themselves<\/p>\n<p>            in fruitful activities under the guidance of the Head Priest,<\/p>\n<p>            local Temple, Motihari and at the end of six months they will<\/p>\n<p>            file a certificate of their conduct in the court below issued by<\/p>\n<p>            the Head Priest.
