She submits that  similar  matters  are  pending<br \/>\nbefore  the Division  Bench and this matter may also be placed before<br \/>\nthe Division Bench for being  heard  along  with  Special Civil<br \/>\nApplication No.  888 of 2004 and allied matters, in which  also  this<br \/>\n very  issue  is  being examined by the Division Bench.\n<\/p>\n<p>Upon supplying the<br \/>\nsecond set, this Special Civil Application  be  placed  before  the<br \/>\nDivision  Bench for hearing with Special Civil Application No.888 of<br \/>\n2004 and allied matters.&#8221;\n<\/p>\n<p>2.\t\tLearned<br \/>\nAdvocate for the petitioner submitted that that the Division Bench<br \/>\nhas decided the issue by judgment and order dated 24.12.2007 and has<br \/>\nheld that the Reviewing Authority does have power to enhance the<br \/>\npenalty imposed by the Disciplinary Authority.  Learned Advocate for<br \/>\nthe petitioner submitted that the matter is now required to be<br \/>\nconsidered in light of the said decision of the Division Bench.\n<\/p>\n<p>2.1\t\tLearned<br \/>\nAdvocate for the petitioner further submitted that the<br \/>\nrespondent-workman was punished with penalty of stoppage of three (3)<br \/>\nincrements with future effect.  The said punishment was considered to<br \/>\nbe insufficient by the Reviewing Authority and the Reviewing<br \/>\nAuthority enhanced the punishment to stoppage of four (4) increments<br \/>\nwith future effect.  This order of Reviewing Authority was challenged<br \/>\nby the respondent-workman by filing Reference (IT) No.127 of 2002,<br \/>\nwhich was allowed by the Industrial Tribunal, Vadodara by award and<br \/>\norder, a copy of which is produced at Annexure-8.  The Tribunal was<br \/>\npleased to quash punishment in toto.
