The appellant is seeking the information about his Account No. in Bank of India.\n   2. What are the rules and regulations of the Bank of India against the services of Zero Balance A\/c\n   3. Why there are the services like free cheque book, ATM Card etc. not provided to the appellant.\n   4. Why there are the complaints filed against the appellant, by the Gen. Manager, Bank of India,\n      Kota.\n   5. Is it true that the Bank had not taken any action against the complaints received to it time to time?\n   6. The appellant want to know that why his A\/c in the Bank is not considered as Salary Account and\n      why the services provided in regard in this are not given to him.\n\nThe PIO reply:\n   1. It is not true that the saving A\/c of Mr. Rajesh Kumar Gupta was opened as salary A\/c. To open a\n       Zero Balance A\/c and a star power salary Account customer must file a Memorandum of\n       Undertaking, which is not filed before opening the A\/c.\n   2. The services provided after opening a star power salary A\/c is mentioned in the Bank's website\n       www.bankofindia.co.in.\n   3. The saving A\/c of Sh. Rajesh Kumar Gupta is a common A\/c.\n   4. There is no information sought by you in point no. 4 &amp; 5.\n   6. This is true that there are four to five Hundred State Government's employees A\/c are considered in\n       the bank in which deposit of salaries are done. All the A\/c are common A\/c. Before opening this\n       A\/c the employee has to filed an undertaking. These formalities are not fulfilled in this A\/c.\n\nGrounds for the First Appeal:\nUnsatisfactory reply was given by the PIO.\n Order of the First Appellate Authority (FAA):\n\"The facts in the application filed by you on dt. 20\/05\/2011 is based on alternate facts that can not be\npresent under RTI Act, 2005 because the new facts cannot be presented. Hence the appeal is disposed\noff.\"\n\nGround of the Second Appeal:\nUnsatisfactory information had been given by the PIO.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant: Mr. Rajesh Kumar Gupta;\n<\/p>\n<p>Respondent: Mr. C. M. Bhanot, FAA on behalf of Mr. P. K. Parashar, PIO &amp; Dy. Zonal Manager;\n<\/p>\n<p>       The PIO has given the information but the following clarification has been made before the<br \/>\nCommission by the Respondent:\n<\/p>\n<p>          1-     Query-4: There is no record sought by the Appellant.<br \/>\n          2-     Query-5: The respondent clarifies that there no complaint on the record.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      The PIO is directed to provide the specific information in writing on query-4 &amp; 5 to<br \/>\nthe Appellant before 25 November 2011.\n<\/p>\n<p>This decision is announced in open chamber.<br \/>\nNotice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                        Shailesh Gandhi<br \/>\n                                                                                              Information Commissioner<br \/>\n                                                                                                     08 November 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.
