The petitioner without<br \/>\nassigning any reasons, dismissed the respondent workman from service<br \/>\nw.e.f. 30.04.1999.  Being aggrieved by the same, the respondent<br \/>\nraised a dispute which was ultimately referred to the Labour Court<br \/>\nfor adjudication being Reference [LCS] No. 46 of 2000. before the<br \/>\nLabour Court, both the parties adduced evidence and after<br \/>\nappreciating the material produced before it, the Labour Court partly<br \/>\nallowed the reference with the aforesaid directions. Hence, this<br \/>\npetition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties. The main contention<br \/>\nraised by the petitioner is that the respondent workman himself<br \/>\nstopped attending the work and  his services were not terminated and<br \/>\ntherefore the judgment and award is illegal and unjust.  On perusal<br \/>\nof the record it transpires that the Labour Court has recorded the<br \/>\nfinding that the services of the respondent were terminated without<br \/>\nany notice nor retrenchment compensation. Apart from that the<br \/>\npetitioner had appointed new persons in place of respondent workman.<br \/>\nIn view of these findings there is violation of provisions of<br \/>\nSections 25F, 25G &amp; 25H of the Industrial Disputes Act. The<br \/>\nlearned AGP appearing for the petitioner is not able to point out<br \/>\nanything contrary from the record that the finding of the Labour<br \/>\nCourt in this regard is perverse.  Therefore, I am of the view that<br \/>\nthe Labour Court has rightly passed the award of reinstatement in<br \/>\nservice.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe result, the petition is dismissed. Rule is discharged.
