Agrawal, J.\n<\/p>\n<p>     This appeal  is directed against judgment of the Orissa<br \/>\nAdministrative Tribunal\t (hereinafter referred\tto  as\t&#8216;the<br \/>\nTribunal&#8217;) dated  September 28,\t 1987 in O.A. No. 44 of 1986<br \/>\nfiled by  the appellant\t assailing the\torder dated March 5,<br \/>\n1986 regarding his premature retirement from service.\n<\/p>\n<p>     The appellant  joined service  as an Assistant Engineer<br \/>\nin the\tIrrigation Department of the Government of Orissa on<br \/>\nApril 1,  1956. He  was promoted as Executive Engineer on ad<br \/>\nhoc basis  on March 2, 1962 and in 1963 his promotion on the<br \/>\npost of\t Executive Engineer  was regularized after obtaining<br \/>\nthe concurrence\t of the Orissa Public Service Commission. On<br \/>\nMay 21,\t 1978 he  was promoted as Superintending Engineer on<br \/>\nad hoc\tbasis and the said promotion was regularized in 1979<br \/>\nin consultation\t with the  Orissa Public Service Commission.<br \/>\nOn November  30, 1984  the appellant  was promoted  as Chief<br \/>\nEngineer (Irrigation) on ad hoc basis and the said promotion<br \/>\nwas regularized\t on the\t recommendation of the Orissa Public<br \/>\nService Commission  on August 23, 1985. By order dated March<br \/>\n5, 1986 the appellant was compulsorily retired from service.<br \/>\nThe order  of compulsory  retirement of\t the  appellant\t was<br \/>\npassed in  exercise of\tthe powers  conferred by  the  first<br \/>\nproviso to  Rule 71(a)\tof the\tOrissa\tService\t Code  which<br \/>\nempowers the  State  Government\t to  compulsorily  retire  a<br \/>\nGovernment servant  after his  attaining the age of 50 years<br \/>\nor  his\t  completion  of  25  years  service  if  the  State<br \/>\nGovernment is  of the  opinion that his further retention in<br \/>\nservice was  not in  public interest.  In the petition filed<br \/>\nbefore the  Tribunal the  appellant has submitted that there<br \/>\nwas no\tmaterial before\t the State  Government to  form\t the<br \/>\nrequisite  opinion   for  his\tcompulsory  retirement\tfrom<br \/>\nservice. The  said contention  has not\tbeen accepted by the<br \/>\nTribunal.\n<\/p>\n<p>     The order of compulsory retirement of the appellant was<br \/>\npassed on  the basis  of the  recommendations  made  by\t the<br \/>\nReview Committee duly constituted for that purpose. The said<br \/>\nReview Committee  in its  meeting held\ton February 15, 1986<br \/>\nreviewed the  service record of five officers, including the<br \/>\nappellant,  who\t had  completed\t 50  years  of\tage  and  it<br \/>\nrecommended premature  retirement of the appellant. From the<br \/>\nproceedings of\tthe said  meeting of the Review Committee (a<br \/>\ncopy of\t which has  been placed\t before us  by\tthe  learned<br \/>\nAdvocate General  appearing for the State of Orissa) we find<br \/>\nthat the  recommendations of  the Review Committee are based<br \/>\non following circumstances :-\n<\/p>\n<p>(1)  There  were  adverse  entries  in\tannual\tconfidential<br \/>\nreports of the appellant for the years 1975-76 and 1977-78,<br \/>\n(2) A  vigilance case  has been\t registered by the Vigilance<br \/>\nDepartment  against   the  appellant   for   possession\t  of<br \/>\nproperties disproportionate to his known sources of income.<br \/>\n(3) The\t appellant  has\t also  been  asked  to\texplain\t the<br \/>\nallegation of  corruption during his incumbency as Executive<br \/>\nEngineer, Balimela Dam Project.\n<\/p>\n<p>(4) Charges  have been\tframed against\thim  for  committing<br \/>\nirregularities\tin   splitting\tup   the  work\t during\t his<br \/>\nincumbency as  Superintending Engineer,\t Central  Irrigation<br \/>\nCircle.\n<\/p>\n<p>(5) His\t explanation has  also been asked for placing orders<br \/>\nwith a\tfirm in\t Calcutta for  supply of  20 tarpaulins at a<br \/>\ncost of\t Rs. 37,759.66\tpaise without  following  the  codal<br \/>\nformalities  and   without    proper  tender  enquiries\t for<br \/>\nascertaining the lowest available rate during his incumbency<br \/>\nas Superintending Engineer, Central Irrigation Circle.<br \/>\n(6) Proceedings\t have also  been  started  against  him\t for<br \/>\ntaking up work of improvement at Kaushalayagang Fishery farm<br \/>\nat an  estimated cost of Rs. 4,22,565\/- and for splitting up<br \/>\nthe contract  into two\tto bring  this within  the financial<br \/>\nlimit of  his power  without obtaining\tthe approval  of the<br \/>\nChief Engineer\tfor splitting up the work and thus violating<br \/>\nthe   provisions of the Orissa P.W.D. code. The matter being<br \/>\nreferred to  the Administrative\t Tribunal for enquiry by the<br \/>\nG.A. (Vigilance)  Department,  the  Administrative  Tribunal<br \/>\nrecommended to demote the appellant to the rank of Executive<br \/>\nEngineer but  the Government after careful consideration had<br \/>\nAdministrative Tribunal\t recommended to demote the appellant<br \/>\nto the\trank of\t Executive Engineer but the Government after<br \/>\ncareful consideration  had decided  to\treduce\t  his  three<br \/>\nincrements.\n<\/p>\n<p>(7)  He\t  was  asked   to  explain   the  charge   that\t  as<br \/>\nSuperintending Engineer,  Central Irrigation  Circle in\t the<br \/>\nyear 1981,  he committed  irregularities&#8217; in  the matter  of<br \/>\ndisposal of  50\t m.t.  of  scrap  steel.  He  submitted\t his<br \/>\nexplanation and the matter is pending further enquiry.\n<\/p>\n<p>     It has  been submitted  by Shri Jatin Das, the  learned<br \/>\ncounsel appearing  for the  appellant, that in the vigilance<br \/>\ncase (circumstance  No. 2),  which  was\t registered  by\t the<br \/>\nVigilance   Department\t  for\tpossession    of    property<br \/>\ndisproportionate to  his known\tsources of  income, a  final<br \/>\nreport was  submitted by  the police  after  completing\t the<br \/>\ninvestigation and  the same  has been  accepted by the Chief<br \/>\nJudicial  Magistrate,\tCuttack\t by   order  dated  February<br \/>\n29,1988. As regards circumstance No. 3 wherein the appellant<br \/>\nwas asked  to explain  allegations of  corruption during his<br \/>\nincumbency as  Executive Engineer,  Balimela Dam Project, it<br \/>\nhas been  submitted by\tthe appellant that on the receipt of<br \/>\npreliminary explanation\t and after  taking the\tview of\t the<br \/>\nEngineer-in-Chief the contemplated proceedings were dropped.<br \/>\nWith regard to circumstance No. 4 about charges being framed<br \/>\nagainst\t the  appellant\t for  committing  irregularities  in<br \/>\nsplitting  up\tthe   works   during   his   incumbency\t  as<br \/>\nSuperintending Engineer,  Central Irrigation  Circle, it has<br \/>\nbeen submitted\tthat after explanation has been submitted by<br \/>\nthe  appellant\t no  further  action\twas  taken  and\t the<br \/>\nproceedings  were   dropped.  The   matter  referred  to  in<br \/>\ncircumstance No. 5 was also dropped. As regards circumstance<br \/>\nNo. 6  relating to  the proceedings  initiated\tagainst\t the<br \/>\nappellant in  respect of Kaushalayagang Fishery farm, it has<br \/>\nbeen  submitted\t that  at  the\ttime  when  the\t matter\t was<br \/>\nconsidered  by\t the  Review  Committee\t the  order  of\t the<br \/>\nGovernment  imposing   the  penalty   of  withholding  three<br \/>\nincrements on  the appellant  had not  been intimated to the<br \/>\nappellant and  that thereafter\tthe appellant had challenged<br \/>\nthe said  order by  filing a petition (O.A. No. 487 of 1988)<br \/>\nbefore the Orissa Administrative Tribunal which petition has<br \/>\nbeen allowed  by the  Tribunal by judgment dated December 4,<br \/>\n1991 and  the order  of the  State Government  imposing the<br \/>\nsaid penalty  has been\tquashed. As regards circumstance No.<br \/>\n7, it  has been submitted that the proceedings in the matter<br \/>\nof disposal  of 50 m.t. of scrap steel has been dropped. The<br \/>\ndropping of the proceedings in respect of circumstances Nos.<br \/>\n3, 4,  5 and  7 has not been disputed by the respondent. Nor<br \/>\nis the\tsubmission of the final report in the Vigilance case<br \/>\n(circumstance  No.  2)\tand  its  acceptance  by  the  Chief<br \/>\nJudicial  Magistrate  as  well\tas  quashing  of  the  order<br \/>\nimposing the  penalty of  withholding  of  three  increments<br \/>\n(circumstance No.  6) disputed\tby the\trespondent. It would<br \/>\nthus appear  that apart\t from the  adverse entries  for\t the<br \/>\nyears 1975-76  and 1977-78  the other circumstances on which<br \/>\nreliance was placed by the Review Committee were proceedings<br \/>\nwherein either\texplanation had\t been  asked  for  from\t the<br \/>\nappellant or  where the\t explanation had  been given and the<br \/>\nmatter was  under consideration\t of the\t authorities and all<br \/>\nthose proceedings  were subsequently dropped. Similarly, the<br \/>\nvigilance  case\t  which\t had  been  registered\tagainst\t the<br \/>\nappellant by  the Vigilance  Department\t for  possession  of<br \/>\nproperties disproportionate  to his  known sources of income<br \/>\nwas at the investigation stage at that time and subsequently<br \/>\nafter completing  the investigation  the appellant  has been<br \/>\nexonerated and the final report has been submitted which has<br \/>\nbeen accepted by the Chief Judicial Magistrate, Cuttack. The<br \/>\npenalty of withholding of three increments which was imposed<br \/>\nby the\tState Government on the appellant in the proceedings<br \/>\nrelating to  work of  improvement in  Kaushalayagang Fishery<br \/>\nfarm has been quashed by the Orissa Administrative Tribunal.\n<\/p>\n<p>     The only  material which remains is the adverse entries<br \/>\nin the annual confidential reports for the years 1975-76 and<br \/>\n1977-78. In  the year  1975-76 the Additional Chief Engineer<br \/>\nhad recorded the did not put his heart and soul to work&#8221;. In<br \/>\nthe year  1977-78 the  Reporting Officer had recorded &#8220;he is<br \/>\ncallous towards\t accounts and  audit and  does work in field<br \/>\nerrectically splitting up work without competent authority&#8221;.<br \/>\nThe countersigning officer made the following remarks :\n<\/p>\n<blockquote><p>     &#8220;During the  period of  report,  he<br \/>\n     had committed  a lot  of  financial<br \/>\n     irregularities  which   could  have<br \/>\n     been avoided  and he  did not apply<br \/>\n     his mind at work.&#8221;<\/p><\/blockquote>\n<p>     These remarks  relate to  the period when the appellant<br \/>\nwas posted as Executive Engineer. Thereafter he was promoted<br \/>\nas Superintending  Engineer in\tMay 1978, and in 1984 he was<br \/>\npromoted  as   Chief  Engineer\t (Irrigation).\tAs   regards<br \/>\ncompulsory retirement  from service  the legal\tposition  is<br \/>\nwell settled :\n<\/p>\n<blockquote><p>     &#8220;The  government\t(or  the  Review<br \/>\n     Committee,\t as  the  case\tmay  be)<br \/>\n     shall have\t to consider  the entire<br \/>\n     record of\tservice before\ttaking a<br \/>\n     decision in  the matter &#8211; of course<br \/>\n     attaching more importance tc record<br \/>\n     of and performance during the later<br \/>\n     years   The   record   to\t be   so<br \/>\n     considered would  naturally include<br \/>\n     the  entries  in  the  confidential<br \/>\n     records\/character\t  rolls\t    both<br \/>\n     favorable\t and   adverse.\t  If   a<br \/>\n     government servant is promoted to a<br \/>\n     higher  post   notwithstanding  the<br \/>\n     adverse remarks,  such remarks lose<br \/>\n     their  sting,   more  so,\t if  the<br \/>\n     promotion\tis   based  upon   merit<br \/>\n     (selection)    and\t    not\t    upon<br \/>\n     seniority.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     [See : Baikuntha Nath Das &amp; Anr. v.<br \/>\n     Chief  District   Medical\tOfficer.<\/p><\/blockquote>\n<p>     Baripada &amp;\t Anr., 1992 (2) SCC 299,<br \/>\n     at pp. 315-316]<br \/>\n     In the instant case, after the remarks were made in the<br \/>\nconfidential reports  for the years 1975&#8211;76 and 1977-78 the<br \/>\nappellant had  been promoted  on the  post of Superintending<br \/>\nEngineer in  the year 1978 and thereafter Executive Engineer<br \/>\nin 1984\t It has\t been pointed  out that\t in respect of years<br \/>\nprior to  1975-76, in  the year\t 1976-77 and  in  the  years<br \/>\nsubsequent to  1977-78 the  performance of the appellant was<br \/>\nappraised as  &#8220;good&#8221; In\t these circumstances,  we are of the<br \/>\nview that  the adverse\tremarks in  the annual\tconfidential<br \/>\nreports for the years 1975-76 and 1977-78 referred to above,<br \/>\nby themselves,\tcannot sustain\tthe opinion  leading to\t the<br \/>\ncompulsory retirement  of the  appellant\/on the\t basis\tthat<br \/>\nfurther\t  retention of\tthe appellant  in service was not in<br \/>\npublic interest\t We are,  therefore, unable  to\t uphold\t the<br \/>\norder of  compulsory retirement\t dated March 5, 1986 and the<br \/>\nsame has to be set aside.\n<\/p>\n<p>     The date of birth of the appellant is April 26, 1933 In<br \/>\nthe normal  course he  would have  retired on April 30, 1991<br \/>\nafter attaining\t the age  of superannuation of 58 years As a<br \/>\nresult of the quashing of the order of compulsory retirement<br \/>\ndated March  5,1986, the appellant has to be treated to have<br \/>\ncontinued in service till April 30, 1991 and for the purpose<br \/>\nof pension  and other  retrial benefits\t the pay  should  be<br \/>\nfixed as  on April  30, 1991  and the  pension\tand  retrial<br \/>\nbenefits payable  to him  should computed  on that  basis As<br \/>\nregards arrears\t of pay\t and other emoluments for the period<br \/>\nfrom March  5, 1986,  the date\tof the\torder of  compulsory<br \/>\nretirement, till  April 30,  1991, the date of his attaining<br \/>\nthe age\t of superannuation,  we are  of the view that having<br \/>\nregard to  the facts  and  circumstances  of  the  case\t the<br \/>\nappellant should  be  paid  50\tper  cent  of  the  pay\t and<br \/>\nemoluments payable to him for this period.\n<\/p>\n<p>     In the  result, the  appeal is allowed, the judgment of<br \/>\nthe Tribunal  dated September  28, 1987 is set aside and the<br \/>\norder dated  March 5,  1986 for compulsory retirement of the<br \/>\nappellant from\tservice is  quashed. The  appellant will  be<br \/>\ntreated to have continued in service till April 30, 1991 for<br \/>\nthe purpose  of pension\t and other  retrial benefits His pay<br \/>\nshall be  fixed as  on April  30, 1991 and pension and other<br \/>\nretrial benefits  payable to  him shall\t be computed on that<br \/>\nbasis. For the period from March 5, 1986 till April 30, 1991<br \/>\nthe appellant  shall be\t paid 50  per cent  of the  pay\t and<br \/>\nemoluments payable  to him.  The said  amount as well as the<br \/>\narrears payable to him on account of revision of pension and<br \/>\nretrial benefits  shall be  paid to  the appellant  within a<br \/>\nperiod of three months.
