No.29531 of 2009\n             ---------------------------------\n            Dated, this the 2nd day of November, 2009\n\n                             J U D G M E N T\n<\/pre>\n<p>      The petitioner is an employee of the 2nd respondent Company.<\/p>\n<p>He is aggrieved by Exts.P14 &amp; P15.\n<\/p>\n<p>      2.    In so far as Ext.P14 is concerned, that is the minutes of<\/p>\n<p>the proceedings for selection to the post of Deputy Manger<\/p>\n<p>(Personnel and Administration) Grade M4.         This shows that the<\/p>\n<p>Company had invited applications from internal candidates for<\/p>\n<p>filling up the aforesaid post, specifying the qualifications, which are,<\/p>\n<p>Post Graduate Degree in Personnel Management or Post Graduate<\/p>\n<p>Diploma in Personnel Management (equivalent to PG Degree) and a<\/p>\n<p>minimum 10 years relevant experience. The petitioner applied in<\/p>\n<p>response to the notification, and eventually, the 3rd respondent was<\/p>\n<p>selected.\n<\/p>\n<p>      3.    Going by Ext.P14, the petitioner&#8217;s qualification and<\/p>\n<p>experience noted are as follows:-\n<\/p>\n<p>      &#8220;2.   Sri.I.Mohammed Sulaiman, Code NO.492,<br \/>\n            Officer in Charge, Grade M6<\/p>\n<p>WP(C) No.29531\/2009<br \/>\n<span class=\"hidden_text\">                                      -2-<\/span><\/p>\n<p>            MA 1988<br \/>\n            PG Diploma in (IR &amp; PM) &#8211; 1990<br \/>\n            PG Diploma in HR &#8211; 2002.\n<\/p>\n<pre>            02\/07\/1984 -        Mazdoor, Gr.E\n            01\/01\/1988 -        Machinery Attendant, Grade D\n            25\/06\/1993 -        Welfare Officer Trainee\n            25\/06\/1994 -        Welfare Officer, M7 Promotion\n            29\/10\/1997 -        Suspension\n            18\/11\/1998 -        Reinstated and assigned as Officer\n                                Special duty.\n            27\/06\/2001 -        Punished for indulging in act\n                                unbecoming of a public servant\n<\/pre>\n<p>                                (withholding of annual increment)<br \/>\n                                three increments\/and job<br \/>\n                                assignment only in Railway liason.\n<\/p>\n<p>            22\/10\/2003 &#8211;        Punishment reviewed &#8211; one<br \/>\n                                increment withholding without<br \/>\n                                cumulative effect.\n<\/p>\n<p>            01\/06\/2004 &#8211;        Personnel Officer, Grade M6 &#8211;\n<\/p>\n<p>                                Promotion &#8211; to continue with<br \/>\n                                Railway Liason works.\n<\/p>\n<p>            25\/06\/2007 &#8211;        Period of suspension from<br \/>\n                                29\/10\/1997 to 17\/11\/1998<br \/>\n                                treated as duty.\n<\/p>\n<p>            27\/09\/2008 &#8211;        Officer in Charge &#8211; Kannur Sales<br \/>\n                                Office.\n<\/p>\n<p>            Total experience in MCL &#8211; 16 years in Managerial cadre<\/p>\n<p>            Date of retirement         &#8211;     31\/05\/2020.&#8221;\n<\/p>\n<\/p>\n<p>     4.     In so far as the 3rd respondent is concerned, the<\/p>\n<p>qualification and experience noticed are the following:-<\/p>\n<blockquote><p>      &#8220;1.   Sri.R.Jayaprakash, Code No.1325<br \/>\n            Asst.Manager (P&amp;A), Grade M5<\/p>\n<p>            B.Sc Zoology &#8211; 1975<br \/>\n            MSW (1977) with specialisation of Personnel<br \/>\n            Management Industrial relations and Labour Welfare<\/p>\n<p>WP(C) No.29531\/2009<br \/>\n<span class=\"hidden_text\">                                     -3-<\/span><\/p>\n<p>           09\/09\/2002 &#8211;        Personnel Officer on<br \/>\n                                      deputation<br \/>\n           21\/02\/2004 &#8211;        Personnel Officer, Grade M6<br \/>\n           09\/06\/2005 &#8211;        Asst. Manager (P&amp;A),<br \/>\n                                      Grade M5<\/p>\n<p>           Total experience in MCL : 7 years<\/p>\n<p>           Prior to20<br \/>\n                    joining MCL :\n<\/p><\/blockquote>\n<blockquote><p>           i)        years experience in Trivandrum Spinning<br \/>\n                  Mills and Kerala Tourism Development<br \/>\n                  Corporation (State PSUs) as Personnel<br \/>\n                  Officer \/ Deputy Manager (P&amp;A)\n<\/p><\/blockquote>\n<blockquote><p>           ii)    Personnel Officer &#8211; 28\/04\/1982 to<br \/>\n                  01\/02\/1992.\n<\/p><\/blockquote>\n<blockquote><p>           iii)   Dy.Manager (P&amp;A) &#8211; 02\/02\/1992 to<br \/>\n                  08\/09\/2002\n<\/p><\/blockquote>\n<blockquote><p>           iv)    2 years experience in Bhagavathy Textiles as<br \/>\n                  Labour Officer &#8211; 1980 to 1982.\n<\/p><\/blockquote>\n<blockquote><p>           Due date for retirement : 30\/11\/2012&#8243;<\/p><\/blockquote>\n<p>      5.   A reading of the experience noticed above itself shows<\/p>\n<p>that the petitioner does not possess 10 years experience in<\/p>\n<p>personnel and administration.           If that be so, the petitioner<\/p>\n<p>admittedly is an ineligible candidate, and what he is impugning is<\/p>\n<p>the selection of the 3rd respondent, who evidently satisfies the<\/p>\n<p>required length of experience prescribed for the post in question. If<\/p>\n<p>that be the situation, I cannot find fault with the Company in having<\/p>\n<p>rejected the candidature of the petitioner.<\/p>\n<p>      6.   Other grievance of the petitioner is in relation to Ext.P15<\/p>\n<p>WP(C) No.29531\/2009<br \/>\n<span class=\"hidden_text\">                                    -4-<\/span><\/p>\n<p>vacancy notification, in so far as it concerns the post of Assistant<\/p>\n<p>Manager (Personnel &amp; Administration). The learned counsel for the<\/p>\n<p>petitioner submits that the petitioner satisfies the educational<\/p>\n<p>qualifications and 5 years experience prescribed for the above post.<\/p>\n<p>      7.    It is not the case of the petitioner that the Company has<\/p>\n<p>taken any decision on the applications received in pursuance to<\/p>\n<p>Ext.P15. On the other hand, he apprehends that, his candidature is<\/p>\n<p>likely to be rejected.\n<\/p>\n<p>      If that be so, at present, no decision prejudicial to the interest<\/p>\n<p>of the petitioner has been taken by the Company.
