Section   ._th:e” e.’:_i”\\.;’Iotor Vehicles Act, seeking<\/p>\n
 compensation fOr..__the persona} injuries sustained by<\/p>\n
 i’1.irr1-.inv.__ti1e’vi.rI10t0r vehicle accident that occurred at<\/p>\n
aboititi  on 29-12-2001. The claim petition<\/p>\n
euwas resisted by the respondent Insurance Company,<\/p>\n
A  the owner of the offending vehicle remained<\/p>\n
  aiiesent and placed ex~parte. On appreciation of orai and<\/p>\n

documentary evidence, the Tribunal. after answering<\/p>\n
the issue regarding actionable negligence in”-,the<\/p>\n
affirmative, quanti\ufb01ed the total compensation  at<\/p>\n
Rs.l,97,540\/– under different heads  <\/p>\n
payment of the said amount with  <\/p>\n
annum from the date of petition tillthe date  dep’os’it.V”g<\/p>\n
The Insurer of the offendin\u00a7”\u00abV._\\xfe.t1_icle”‘w’as’V’:directed to
\nsatisfy the award.\n<\/p>\n
4. Being diss’atistied’  quantum of<\/p>\n
compensation   the fTri’our1a1, the appellant<\/p>\n
claimant hliaslvj’.presehte:d~\u00ab–..this_– appeal, inter alia, on the
\nground that_ has committed error in not<\/p>\n
awarding any’ compensation for the loss of future<\/p>\n
 “account of permanent disability suffered by<\/p>\n
 a’~resul’t of the accidental injuries.<\/p>\n
  “Upon service of notice of this appeal, the<\/p>\n
 secondvvllrespondent Insurance company has appeared<\/p>\n
 tthlrough its learned counsel. We have heard both sides.<\/p>\n
V Hi3erused the records.\n<\/p>\n<\/p>\n
6. The manner in which the accident occurred<\/p>\n
and the resultant injuries sustained by the a.p’pe_’llant<\/p>\n
claimant are not in serious dispute. The  ”<\/p>\n
counsel for the appellant vehevm’e’n-tly  <\/p>\n
though the claimant in   evidence ”\n<\/p>\n
categorically stated that ohalccount of  accidental it<\/p>\n
injuries he has left the  thoughthe said
\nassertion on his  has
\nnot been challenged  ,Ve3\ufb02arnination by the
\nInsurance has committed error
\nin towards loss of future
\nearningl”oVn’– account._lof~l.::5cr1nanent disability. It is his<\/p>\n
further subumissioyh that: if not 100%, at least 60% of<\/p>\n
llossi’-of future earning ought to have been awarded on<\/p>\n
1 -the;~basi:’s~.of th.e.1medical evidence available on record.<\/p>\n
A  7. V.  other hand, the learned counsel for the<\/p>\n
ll.”~’~___l’-\u00bb.lnsurer,V__Alsought to justify the judgment and award<\/p>\n
it  rconte–nding that in the absence of any evidence adduced<\/p>\n
    the claimant to show that he has left the job after the<\/p>\n
.fg}\/<\/p>\n
accident, the Tribunal is justified in not awarding any<\/p>\n
compensation towards loss of future earning. Thjerefore,<\/p>\n
the judgment and award does not cail for  ‘<\/p>\n
by this Court.\n<\/p>\n
8. The evidence on record  establishes <\/p>\n

\nimpatient in  2001 to

\nhas  suffered by the

60% -The llPi1ysicai1y’-handicapped Certificate produced<\/p>\n
.  auswlper EX.Pi3 issued by the District<\/p>\n
  Officer, Dakshina Kannada District,<\/p>\n
Mafigalore-.,,ll\u00ab:would also indicate that the appellant has<\/p>\n
 ]siiff_eretii*’t5O\u00b0\/(3 physical disability. In fact, the Insurance<\/p>\n

this certi\ufb01cate the appellant was employedv….\u00a7isVV’:\u20aciaiesV.<\/p>\n
Clerk in the said Society on a  <\/p>\n
Rs.3,108\/- and he was liable tog\ufb01ayi:Api<o'ressio;ia1u<\/p>\n
Rs.25\/– per month. The appellant—-e$\u00a7amined. .hi'rriself<\/p>\n
PW}. In his Examinationwin~iVCh.ief,_ helhasasseixited that
\non account of the accidental  has lost Control
\nover the bladder and.   he has no<\/p>\n
sensation in his ;?btoth.v l'0wtef: lii';4ib_s"'an'd"'on account of the<\/p>\n
impla1tihtsmini* he cannot lift his right
\nhand  he  asserted that after the<\/p>\n
accident, oii._:accsunt  the disability, he has left the<\/p>\n
l  3fl'1e"l'Societ'}Vf""and after the accident, he is taking<\/p>\n
A'–co\u00a3I}plete~..;'est~.in his house as he is unable to move and<\/p>\n
woi\ufb01x. 'l,a'l1'c,f2'elri1sal of the cross examination of PW} on<\/p>\n
  J'beVl1_al.t the Insurance Company indicates that there is<\/p>\n
   even a suggestion to PW1 that he has not left the<\/p>\n
 "job and that he continued to work in the Society as<\/p>\n
fl<\/p>\n
Sales Clerk. in the absence of any such challenge to the<\/p>\n
evidence of PW}, there is no difficulty in accep\u00abtir1g\u00ab.i_his<\/p>\n
evidence. As the insurance Companj\ufb02 has '<\/p>\n
challenged the assertion on the part of if if<\/p>\n
he has left the job on acco11i'nt:'.-A.'odff <\/p>\n
disability, there was no need\u00bb or' occasivonfufor if the ''<\/p>\n
claimant to have prodsicedyitcanyc:'docuimentarywt"evidence
\nfrom the Society to   the job. In<\/p>\n
fact; the Insu;ra.ri_'ee =Co1__n.pany,'*  was able to<\/p>\n
produce the   per Ex.R1, there was
\nno dif\ufb01icnity  odhtaiined similar certi\ufb01cate
\nfrom  uSocVietyV,. appeilant has not left the<\/p>\n
job in the  Society. "Therefore, having regard to the<\/p>\n
,…\u20ac,yid\u20acf1cAet 0f1..record';'vJe are of the opinion that the say of<\/p>\n
  that he has left the job on<\/p>\n
acceunt'  the accidental disability deserves to be<\/p>\n
Jacceptesii and we accordingly, accept the same.<\/p>\n
  E\ufb01ievertheless, having regard to the oral evidence of the<\/p>\n
 -c’-fioctor, who assessed the physicai disability and the<\/p>\n
Certi\ufb01cate produced at Ex.l313. we assess the functional<\/p>\n
disability of the appellant at 60%. The appellaritwas<\/p>\n
aged about 43 years as on the date of <\/p>\n
Therefore, the appropriate multiplier  as<\/p>\n
per the judgment of the Apex  <\/p>\n

durati’on of treatrnent, the award passed by the Tribunal<\/p>\n
 is just arid reasonable and they do<\/p>\n
I1o’t__call __in:t’e’rferenee by this Court.<\/p>\n
 herefore, in View of the above discussion. the<\/p>\n
V’  appeal  allowed in part. The appellant is entitled to<\/p>\n
total compensation of Rs.ES,O8,306\/- as against<\/p>\n
Rs.1,97.540\/- awarded by the Tribunal. The enhanced<\/p>\n
compensation of Rs.3,10,766\/– shall carry inter;es_t’~Vat<\/p>\n
6% per annum from the date of petition   <\/p>\n
deposit.   y<\/p>\n
The second respondent Irisilirer <\/p>\n
deposit the entire enhanced'”eonipensation  interest it<\/p>\n
within six weeks frorrrthe   re’c.eipt \u00e9fcopy of the<\/p>\n
